An unannounced inspection was conducted by Licensing Program Analyst (LPA) Roxana Lopez on 8/17/2023. A COVID risk assessment was conducted. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 07/11/2023. LPA met with Director Elodia Barnhart to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children, and parents. LPA also reviewed and obtained copies of children’s rosters and personnel reports.

An interview was conducted with the complainant to obtain further details regarding the allegations made. Per the initial complaint report, the complainant reported that Child # 1 disclosed that Staff # 1 smacked them on the hand and that Staff # 2 pulls their ear when they don’t listen. Per the complainant, they have also witnessed their child being restrained in a stroller- when the complainant asked why, they were informed because the child was not listening. LPA was unable to interview victim.

Regarding allegation # 1 a teacher smacked the child’s hand: # 2 A teacher pulled the child’s ear, and # 3 Child was restrained in the stroller: LPA conducted interviews with the complainant, children, and staff.

LPA conducted interviews with staff # 1- 4. All staff statements corroborated that they have not smacked a child on their hand, pulled a child’s ear, or restrain children in a stroller and have not witnessed any staff smacking a child, pulling a child’s ear, or restraining children. Staff # 1-4 corroborated that if children are having a hard time they talk to the child and redirect the child. Staff also corroborated they have a table where they provide different activities for the children as needed and that they do not have strollers in the preschool area. LPA conducted inspections on 7/20/23 and 8/17/23 and did not observed any strollers.

LPA conducted interviews with parents and children. Children’s statements corroborate that they like their teachers and that they have not been hurt or restrained by any teachers and have not witnessed other children being hurt or restrained. Parent # 1 and 2 statements corroborate that they have no concerns with the school. Parent # 3 disclosed that their child did not like attending the school because Staff # 1 is mean. Child was unavailable to interview.

This agency has investigated the complaint alleging the day care child was smacked on the hand, the ear was pulled and restrained while in care. Based on the evidence presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.
