An unannounced inspection was conducted by Licensing Program Analysts (LPAs) Roxana Lopez and Jessica Hopkins- Hernandez on 1/11/2024. A COVID risk assessment was conducted. The purpose of this inspection is to provide the findings of the complaint investigation which was received on 11/2/2023. LPA met with Director Elodia Barnhart to whom the purpose of the inspection was announced. Census was taken.

Throughout the course of the investigation, interviews were conducted with staff, children, and parents. LPA also reviewed and obtained copies of children’s rosters, personnel reports and other documentation.

An interview was conducted with the complainant to obtain further details regarding the allegations made. Per initial complaint report, the complainant reported that Child # 1 has had different injuries since May 2023. Reporting party disclosed that they have received incident reports for the incidents and that they were recently called by facility stating that they have observed bruising marking on child’s #1 arm.

Per Reporting party child # 1 did not have marking's when dropped off at the facility. LPA was unable to interview victim.

In regards to allegation # 1 Day care child sustained unexplained injuries while in care LPA conducted interviews with complainant, children and staff.

LPA conducted interviews with staff # 1- 5. All staff statements corroborated that they have not hurt a child, pulled, or grab on a child’s arm and have not witnessed any staff hurting a child, pulling or grabbing a child. Staff # 1-5 corroborated that if children are having a hard time they talk to the child and redirect the child. Staff also corroborated that when there is an incident, they tend to the child’s needs first and then fill out an incident report that is provided to parents during pick up. Depending on the injury parents may be contacted immediately. Additionally, if staff observed any marking's, they will contact parents to inform them.

LPA conducted interviews with parents and children. Children’s statements corroborate that they like their teachers and that they have not been hurt by any teachers and have not witnessed other children being hurt. Parent’s statements corroborate that they have no concerns regarding the supervision provided to their children or concerns with teachers. Parents also corroborated that they have received incident reports when their child has had an incident.

This agency has investigated the complaint alleging day care child sustained unexplained injuries while in care. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.

There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
