Licensing Program Analyst (LPA) Roxana Lopez conducted a Case Management Deficiencies visit on this date to address deficiencies revealed during a Case Management Lead inspection. Census was taken.

Initially LPA arrived at the facility at 1:50 pm. Upon entering the facility there was no one in the front office, therefore LPA went inside the 4-5 year old classroom were there was 1 teacher with 13 children 3 of them awake. Per teacher, they were by themselves and informed LPA that Director was in the next classroom. LPA then proceeded to the 2's classroom, LPA observed the Director with 13 children 3 of them awake. Director informed LPA that she was short staff and out of ratio across the board- including infants. This poses an immediate health and safety risk for children in care. A visit was conducted in infant facility too.

As LPA was getting ready to print the report at around 5:00 pm, LPA observed a child walking through the empty 3 year old classroom by themselves. LPA approached the child and ask where they were going? Child pointed to the 4-5 year old classroom- LPA asked teacher in the classroom if the child was from the 4-5 year old class and or if parents were here. Teacher advised that child was from the 2 year old class. LPA then walked to the two year class and asked the teacher if they were missing a child- teacher proceeded to count and realized that 1 child was missing. Per teacher they were changing a diaper and did not observed child leave the classroom. This poses an immediate health and safety risk for children in care.

Based on LPA observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety-

LPA Roxana Lopez informed Facility Representative Elodia Barnhart that this report dated 2/22/2024 document(s) 2 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Roxana Lopez informed the Licensee to provide a copy of this licensing report dated 2/22/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Exit interview conducted and report was reviewed with the Facility Representative Elodia Barnhart.

Per Director- they are short staff- they called the sub list and were not able to get a sub. Director states that they are working on hiring a new teacher and will not accept children if not enough coverage. Written plan will be submitted to LPA by 3/1/24.

During inspection- the Director stepped in to the classroom. Per Director they will have a staff meeting to addressing the lack of supervison and will submit a written plan on how direct supervision will take place at all times. Plan will be submitted to LPA by 3/1/24
