On 01/05/26 at 10:30 a.m., Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced complaint investigation to deliver findings to the above allegation. LPA met with the facility representative who guided LPA on a tour of the facility. There were 09 children with 01 staff.

According to the Reporting Party (RP), “Staff yelled at day care child.” LPA conducted interviews with staff 1 (S1) thru 5, child 2 (C2) thru 6, and parent 1 (P1) thru 5. LPA also obtained a copy of children’s records.

Allegation- Staff yelled at day care child. According to the RP, C1 disclosed that teachers (names/dates unknown) always yell at children (names/dates unknown). LPA spoke with the RP on 10/08/25 to obtain additional information. Per the RP, there are 5 staff at the facility; however, RP couldn’t identify the teachers during the interview. The RP revealed that C1 was hesitant to attend the facility due to the child expressing during drop off that the facility is a” bad school.” LPA attempted to contact the RP via phone on 10/09, 12/18, and 12/22 via mail; however, the RP did not respond. According to RP C1 stated that staff is constantly yelling; no additional information was provided.

LPA conducted interviews with S1 thru 5 who made no disclosures. Interview conducted with S1 revealed that staff don’t yell at children; however, S3 is the loudest person but doesn’t mean to be loud. Interview conducted with S2 revealed that staff do not yell at children; however, children in the school age program tend to be a little loud. Per S2, they have not witnessed any staff yelling at children including staff from the preschool program. Interview conducted with S3 revealed that they speak loudly; however, staff do not yell at children. Interviews conducted with S4-S5 all denied yelling at children. LPA also interviewed potential witness (W1) who provides drop in services to clients in care. Interview conducted with W1 revealed that different teachers use loud voices to grab children’s attention; however, it’s not intentional. W1 also stated that staff’s voices are firm but without a malice intent and that children with special needs may require a firmer tone. W1 couldn’t identify the teachers, children, dates, or time.

LPA conducted interviews with C2 thru 6 who made disclosures. Interview conducted with C5 revealed that S5 has an attitude and will yell for children to pay attention. Per C5, S5 has yelled at C2 and C3. LPA attempted to conduct interviews with C2 and C3 who made no disclosures. Interview conducted with C6 revealed that staff are sometimes loud (name/date not provided); however, staff are happy.

Interviews conducted with P1 thru 5 did not reveal any information that corroborates the allegation. P1, P2, and P5 stated that they have no issues or concerns regarding the facility or staff.

This agency has investigated the complaint alleging “Staff yelled at day care child.” LPA found conflicting statements regarding the allegation and therefore have found the complaint to be deemed UNSUBSTANTIATED. Meaning that, although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

A notice of site visit was given and must remain posted for 30 days.

An exit interview was conducted, and a copy of this report was provided to the facility representative Ana Espindola.
