25 | On 03/23/26, Licensing Program Analyst (LPA) Staicy Perry conducted an unannounced case management inspection for an Action Level Exceedance (ALE) detected in water fixtures in the facility. LPA Perry entered the facility and was greeted by Elodia Chavez, assistant Director and also greeted by Adela Munoz, Director once the door was opened for LPA. LPA Perry was guided on a tour of the facility. Census was taken, LPA Perry observed 32 children in care. Per facility director, there are currently, 32 children enrolled.
LPA reviewed new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility representative during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.
Facility provided facility sketch and required forms LIC 9276, LIC 999 and LIC 9275 to the department via email. The Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report indicated the facility was inspected and samples were collected on 9/25/2024. Faucets reported with 5.5 ppb or greater lead exceedance levels were as follows:-
·Sample Site I (9.100 UG/L) – Faucet with attached drinking fountain, currently not in use and permantly removed and is now a cemented in plantar.
Per Facility Director, the drinking fountain (identified as Faucet “I”) located in the outdoor playground was tested and found to have elevated levels of lead exceeding allowable limits. The facility reported that the affected drinking fountain was immediately capped and sealed to prevent use. The Facility Director provided photographic documentation to LPA, and LPA observed that Faucet “I” in the playground has since been permanently removed and is now a plantar that is cemented.
The Facility Director further stated that children are required to bring their own water bottles. The facility refills water bottles as needed using filtered water or from a water source that has been tested and does not contain elevated levels of lead.
