32 | During this investigation LPA conducted interviews with staff and parents. Regarding allegation # 1 Facility is operating out of ratio- Staff interviews corroborated that they have never been out of ratio. Per Staff # 1 they are available to cover the infant classroom when needed and call every 30 minutes to check on ratio. Staff # 2 stated that director calls every 30 minutes to check on ratio- however if they get the 4th child they call to request help and the Director or floater comes to support the classroom. Staff # 3 corroborated with staff # 2 and stated that this process is done through out the day as well when children are napping. Parents interview corroborated that they have never observed the facility out of ratio. Parent # 3 stated that once their child was the 5th child and staff called for help, a staff member arrived to help before parent left.
Regarding allegation # 2 Staff left daycare children unattended- Staff interviews corroborated that they have not left children unattended in the playroom or eating area. Staff # 2 stated that if one child has to eat they will bring the other 3 children with them and feed them if needed or provide them with different activities while the other child is being fed. Staff # 3 disclosed that they call for support if needed- or will take the children with them to the area they are moving too. Parents interviews disclosed that they have not observed children to be unattended.
LPA Lopez conducted visits on 11/03/2023, 11/29/2023 and 1/11/2024 and observed the facility to be in ratio throughout the day as well as all children supervised at all times during the visits. Additionally LPA reviewed time cards for the time period of 11/1/2023 - 11/30/2023 and 1/1/2024-1/11/2024. After the review it appears the facility had adequate staffing available to be in ratio during those times.
This agency has investigated the complaint alleging facility was out of ratio and children are left unattended. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated.
There were no deficiencies cited on the above-mentioned allegation per California Code of Regulations Title 22. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
