32 | LPA obtained photos of children without masks in Classrooms 5, 6, 8 and photos also show that the children without masks did not have one near their person.
Interview was conducted with Director who stated that some parents do not want their children to wear a mask and that the facility is "flexible" with parents' decision about masks. Director also stated that masks are made available by the facility. Interview was conducted with Staff 1 who stated that about half the children bring a mask, and the other half do not. Staff 1 stated that they will offer a mask to the children even if they do not bring one. Interview was conducted with Staff 2 who stated that not all parents bring their children with masks and that the facility does not currently have masks available to children. LPA inventoried and observed classrooms to have extra masks available.
Based on the LPA's observations and interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. A Technical Violation was issued.
Director understands that face masks may be removed during nap time or when the children are eating and drinking. LPA provided Director with a copy of the Guidance for Early Childhood Education Providers Requirements and Best Practices by the County of Los Angeles Public Health. LPA also provided Director with a copy of Guidance for Child Care Providers and Programs issued by the California Department of Public Health (CDPH).
The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
Exit interview conducted with the Director, during which appeal rights were given and explained. A copy of the Appeal Rights was provided. The Director's signature on this report acknowledges receipt of rights. |
