Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced site inspection to present the findings of the above complaint allegations. LPA met with Administrator Ellen Head, who the complaint was gone over.

During the course of this investigation interviews were conducted with the Director, staff, children and other witnesses. Licensing staff reviewed and obtained copies of the facility children and staff roster. Children's and staff files were reviewed.

Allegation: Facility is operating out of ratio. Per interviews it was determined that staff #4 was caring for more then 12 children alone in the class room and is not hired for or is a qualified teacher or teachers aid. Staff #4 is a volunteer only.

During the course of this investigation interviews were conducted with the Director, staff, children and other witnesses. Licensing staff reviewed and obtained copies of the facility children and staff roster. Children's and staff files were reviewed.

Allegation: Staff did not provide a comfortable temperature for children in care. Per interviews it was stated that temperatures are comfortable for the children and staff and are adjusted if needed. The facility has not had any complaints from a child or staff regarding the tempeerature.

This agency has investigated the complaint alleging Staff did not provide a comfortable temperature for children in care. Although the allegation may have happened or is valid; there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the allegations are deemed Unsubstantiated. Should additional information become available in the future, this investigation may be reopened.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with facility representative, Administrator Ellen Head.

Allegation: Facility is operating beyond the terms and conditions of the license. Per complainant a few of the staff do not have any ECE units, but they are working as teachers at the facility. Per interviews it was stated that there are qualified teacher and teacher assistant caring for the children and some staff do not know who is qualified or not and for what position. However it was stated that the volunteer staff #4 cares for the children alone some times and is not a qualified staff. Per LPA review of the staff files and the staff personnel report, LPA observed Teachers listed are qualified, however some of the teacher aids do not have proof of any education requirements. It was stated that teacher aids have not been alone with the children except if the teacher steps to the rest room quickly. Staff #4 also did not have proof of education as she is only a volunteer at the facility and should not be alone with the children at all. Interviews stated the volunteer has been alone in the class room and on the play ground with day care children.

Allegations: Facility is unsanitary and Facility has an infestation of rats. Per interviews and LPA observation it was stated the facility had a rat issue and droppings were observed in the class room and in the staff bathroom/equipment room. The facility had placed new flooring and under the old floor was rat droppings and urine stains. Director has piles of containers with different items and loose items, such as papers, toys, books and house keeping supplies. LPA observed paper work piled up in corners and different sections of the class room as well as in the directors office and supply room, which is very cluttered. Per interviews the toys are not clean as often as they should be and children are always putting toys in there mouth daily. The fish tank has not been clean and shelves are not wiped down and are dusty and dirty. Per Director a cleaning crew comes in each night and wipes things down and sweep and mop.

Allegations: Staff yell at children and Staff use inappropriate forms of discipline. Per interviews all staff are load, however the Director literally yells at the staff in front of the children some times and in front of parents and yells at the kids and some staff might even yell back at the director because they are tired of her yelling at them. Per interviews the director wont let a child eat there lunch the way they want to eat it and if they don't eat her way then they cant eat at all. The Director will tell the children they have to eat there sandwich first then they can have there juice or snack. Some children wont eat any lunch at all and may only get the PM snack we give and that's it all day.

Based on the available information, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, (Title 22, Division 12 & Chapter Number 1), are being cited on the attached LIC 9099D.

Upon receipt of this report, the licensee shall post any licensing report documenting a type “A” citation and/or a substantiated complaint. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

A notice of site visit was given and must remain posted for 30 days. Exit interview was conducted with Administrator Ellen Head. Appeal Rights explained and provided.

Buildings and Grounds. The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. The licensee shall take measures to keep the center free of flies, other insects and rodents. This requirement is not met

Director states she had set traps at the time of observing the rat feces and urine and as of this date is cleared of any rodents. All items that were observed to have signs of rats were disposed of. Directors states she will have a cleaning log for the staff to use to document when cleaning is conducted and

as evidenced by interviews conducted and LPA observations that the facility had a issues with rats in the facility. It was also determined that the facility is cluttered and dirty and needs toys and equipment cleaned. This is an immediate risk to the health and safety of the child in care

Director states will work on disposing of excess items in the facility and will document and submit to the department all steps that will be taken. Director will submit plan of correction by 04/21/2023.
