Licensing Program Analyst (LPA) Judy Mora conducted an unannounced site inspection on this date to conclude the investigation for the above complaint allegations. LPA met with Site Supervisor, Alicia Lomeli. LPA observed 19 infants present with 07 staff at the outdoor play yard at approximately 10:25 AM.

During the course of this investigation, interviews were conducted with the facility staff and additional witnesses. LPA also reviewed and obtained a copy of the facility roster and the most updated Parent Handbook. Based on the available information, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 1), is being cited on the attached LIC. 9099D. Staff and witness statements were consistent with the information provided. Parents were recently allowed to re-enter the facility to the door of the infant program in March 2023. Parents who are not wearing a mask are still not allowed into the facility.

Upon presentation of identification, the responsible parent or guardian of a child receiving services in a child day care facility has the right to enter and inspect the facility without advance notice during the normal operating hours of the facility or at any time that the child is receiving services in the facility. Parents or guardians when inspecting shall be respectful of the children's routines and programmed activities. The facility shall inform parents and guardians of children receiving services in the facility of the right of the parents and guardians to inspect the facility pursuant to this section.
This requirement was not met as required as evidenced by staff and witness statements. Parents were just recently allowed to re-enter the facility in March 2023. Parents who do not ear masks are still not allowed into the facility. LPA observed that this is not documented as a requirement in the parent handbook.
This is a potential risk to the health and safety of children in care.

LPA observed that this is not documented as a requirement in the parent handbook; instead the handbook indicates that, "parent/guardians are welcome to visit the program unannounced, at any time during regular program hours". This is a potential risk to the health and safety of children in care.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation OR substantiated complaint. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year.

A copy of the Parent Notification Requirements was provided to the licensee, along with a copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports.

Exit interview was conducted with Site Supervisor, Alicia Lomeli. Appeal rights and procedures were explained.
