Licensing Program Analyst (LPA)Katrina Chicote conducted an Unannounced Required – 1 Year inspection to the above facility on 06/10/22 at 1:00 PM. LPA called Licensee for the purpose of COVID-19 screening call. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, Esther Garcia, who guided the LPA on a tour of the facility. Adults in the home were discussed and all have criminal record clearance. Also present was A1, Licensee’s Assistant, who has criminal record clearance.. There were six day care children present upon LPA's arrival with one child arriving later, totaling seven children during today’s inspection. Licensee states that there are currently 13 children enrolled. The children's roster was reviewed and is current. Per Licensee, the facility’s hours of operation are 6:00 AM to 6:00 PM Monday thru Friday. Emergency Disaster Plan, License, and Parents’ Rights were posted at the time of inspection. Disaster drill log was also available during today’s inspection, last disaster drill conducted on 05/2022.

This is a single-story home which consists of three bedrooms and two bathrooms, kitchen, main daycare space, and converted detached garage for daycare activity space. Areas used by the children include main daycare space (located upon entry of the home), Bathroom 1 (located through main daycare space, down hallway, to the left), Bedroom 3 (located down hallway, to the rear of the home), and detached converted garage for daycare activity space (backyard). Per Licensee, areas off limits to children and parents include Kitchen and Bedroom 1 and Bedroom 2. At 1:05 PM, LPA observed that there is a door with child safety door knobs blocking access to Kitchen. Per Licensee, Bedroom 1 and Bedroom 2 are locked during operating hours, and LPA observed doors to be locked at time of inspection.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. LPA observed ceiling fans and A/C wall units all through out home. There is a working telephone maintained in the home. At 1:04 PM, LPA observed main daycare space to have child size tables and chairs, shelves with plastic bins with plastic manipulatives, art supplies, books, and other age appropriate toys, free of loose and sharp parts.

LPA observed electrical cover outlets all through the home. LPA observed a dog barking on side yard upon arrival, Licensee states dog is kept separate from children during daycare hours. LPA observed dog to be kept separate from daycare children during inspection. At 1:07 PM, LPA observed Bathroom 1 to have operable toilet and sink, operable child safety locks on all under cabinet sinks and drawers, floor and tub free of hazards, with adequate hand washing and toileting supplies at time of inspection. At 1:09 PM, LPA observed Bedroom 3 to have television on wall, sleeping mats used for napping, and child size table and chairs stacked. Licensee states this room is used for homework time and after school children. Licensee states Bedroom 3 is also used for sick/isolation area when not in use. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. Licensee states these items are stored in off limits Kitchen area. LPA observed these items to be stored in Kitchen in locked cabinets. The Licensee states that there are no poisons in the home. The Licensee does understand that poison must be locked with a key or combination lock. Per Licensee, they provide food for children in care and use main daycare space to eat.

Per Licensee, the children will have access to backyard for outdoor play, which is accessible down hallway through backdoor in Bedroom 3. At 1:15 PM, LPA observed backyard has concrete through out, shaded area, and adequate perimeter fencing through-out the yard. LPA observed basketball court in the rear of the home, bicycles, scooters, and other age appropriate toys free of loose and sharp parts available for the children in the backyard at time of inspection. LPA observed drinking water fountains available in backyard, Licensee states these are still currently not being used due to COVID. LPA observed outside sinks available for children. At 1:20 PM, LPA observed detached converted garage that Licensee states is used for daycare activity only. Licensee understands that detached garage cannot be used for eating or napping. LPA observed detached converted garage to have child size tables and chairs, large storage cabinet filled with art supplies and books, computer area, and toys available for children free of lose and sharp parts. At 1:22 PM, LPA observed Bathroom 2 that is inside detached converted garage to have two toilets and two sinks available for children in care, changing table, floor free of hazards, with adequate hand washing and toileting supplies at time of inspection.

Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA observation did not see any bodies of water around the premises or firearms/weapons in the home at time of inspection.

At 1:05 PM, LPA observed the valve on the required 2A 10BC fire extinguisher indicates fully charged with service tag dated 06/03/21 (Technical Violation provided). At 1:30 PM, LPA observed the smoke and carbon
monoxide detectors are in operable condition. Per Licensee, First Aid kit is kept in the main daycare space, LPA observed First Aid kit and was inventoried for necessary supplies. The Licensee has current Pediatric First Aid and CPR. Proof of immunization against influenza and measles was readily available during today’s inspection but Licensee did not have proof for pertussis (Technical Violation provided). The Licensee has taken the Mandated Reporter Training

Incidental Medical Services (IMS)
This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. Licensee (or facility representative) was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Rooms that are off-limits need to be made inaccessible during operating hours. NO smoking, NO infant walkers, NO Johnny jumpers, NO saucer chairs, NO incline sleepers and any other item that falls into that category are permitted in the facility. Effective January 1, 2010, licensees of family child care homes are required to ensure that at least one staff member with current training in pediatric first aid and pediatric CPR is on site at all times when children are present.

The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the children in care.

LPA discussed the safe sleep regulations with licensee
[or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Role and responsibilities of being a Mandated Reporter were reviewed. The Licensee was advised how to access forms and Regulations online at www.ccld.ca.gov. Licensee was made aware that it is his/her responsibility to know the regulations as well as anyone who assists in providing care.



AB 1207: Beginning on January 1, 2018, this law requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Volunteers are encouraged but not required to take the training. Website: http://www.mandatedreporterca.com/

Senate Bill 792: this bill, commencing September 1, 2016, prohibits a person from being employed or volunteering at a child care facility or family day care if he or she has not been immunized against influenza, pertussis and measles. LPA discussed the influenza waiver during the visit.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today, 06/10/22.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
