The purpose of the visit was to ensure that health, safety and personal rights as required by Title 22 Regulations governing California Family Child Care homes will be met by the Applicant. LPA met with Estela Rodriguez, Applicant, who guided analyst on a tour of the facility. Carlos Rios, adult son, was present during the inspection. Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. The applicant is requesting a large family child care home license with a capacity of 14. The applicant provided proof of control of property. Applicant is buying their home and submitted a copy of a payment coupon from the mortgage company. Per applicant, operation hours will be Monday to Sunday from 12:00AM – 11:59PM. Applicant states they will care for children 0 months old to 7 years of age. Entrance Checklist was provided to the applicant. Applicant stated that a cell phone with active service in the home will be the main contact number while children are in care. All areas identified on the facility sketch were inspected, including but not limited to, off limit areas. This is a 1-story home that consists of 4 bedrooms, 2 bathrooms, living room, dining room and kitchen. ---Page 1 of 5

Per applicant, the children will use the following areas: living room, and bathroom. All other areas are made inaccessible by the use of a gate and safety door knobs.

There are toys available for children in the living room. 7 cots for napping were observed and 2 play yards were observed in the home.

Outdoors, is a fenced cemented area. Areas are the front of the home, side yard and back area. Back yard will be accessible to children.

Pool regulations are as follows: per Child Care Regulation 102417(g)(5) Operation of A Family Child Care Home (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.

Per Child Care Regulation 102417(g)(5)(A) Operation of A Family Child Care Home (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

LPA observed a build in pool in the back yard of the applicant’s property. The pool fencing is made of rod iron with a bamboo fence panel attached to the fence. Entrance gate to the pool was observed to swing away from the pool. The gate has a latch. However, the latch is not a self-latching pool gate latch and does not meet requirements. The fence does not surround the pool and fence is attached to a detached garage with two windows and door with direct access to the pool. During today's visit, LPA shared the bodies of water video with Applicant.

Areas that will be used by children were inspected for safety, comfort, cleanliness, ventilation and heating. Detergents, cleaning compounds, medicines, sharp objects and hazardous items that can pose a danger to children are inaccessible in areas designated for children. ---Page 2 of 5

The applicant was advised that any poisons must be locked. Per applicant, there are no pets on premises. LPA did not see any pets in the home during the inspection.

Per applicant, there is no firearms on premises.

There is both a smoke and carbon monoxide detector that was tested, operable and located in the living room where care will be provided.

There is a 2A10BC fire extinguisher in the kitchen area. Per applicant, fire extinguisher was last serviced on 03/19/2024.

There is central air conditioner and heating in the home and temperature can be adjusted using thermostat located in the hallway near the bathroom accessible to children.

The applicant has completed the required Health and Safety Training, Nutrition Training and Pediatric First Aid and CPR. Certificates of completion were submitted with application. There are first aid supplies available and stored in an area inaccessible to children.

The applicant states that they will provide food for children in care. If food is not provided and food is brought from the children's homes; container shall be labeled with child's name and properly stored or refrigerated.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed [applicant, licensee, or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

On this date, 03/11/2024, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms.

Prior to Licensure the following is required, and the applicant will complete by 7/26/2024:

• TB and Immunization's (Measles, Pertussis, Influenza) for Fernando Rios, Spouse
• TB and Immunization's (Measles, Pertussis, Influenza) for Carlos Rios, Adult son
• Per Applicant, pool will be made inaccessible by installing self-latching pool locks to the fence, replace the bamboo panel with a material that does not obscure the view to the pool, install door chimes to back door exit and garage door. Applicant stated that they will also make alterations to block windows that have direct access to the pool.

A large family child care license may be granted upon receipt of proof of corrections for the above. A follow up inspections will be required to ensure the inaccessibility to the pool meets requirements. Once licensed, the applicant is required to adhere to the terms and limitations stated on the license. A copy of this report and all other Licensing reports must be made available to the public for 3 years.
