25 | Licensing Program Analysts (LPAs) Lilia Hernandez and Roberto Luque Avila met with applicant Estela Rodriguez on 07/16/2024. The purpose of the visit was a 2nd announced pre-licensing inspection at the home to ensure that health, safety and personal rights as required by Title 22 and Health and Safety Regulations governing California Child Care Homes will be met.
No children observed at visit.
On 06/26/2024 LPA conducted the 1st pre-licensing visit. Applicant was advised that the in-ground pool located in the backyard shall be made inaccessible to children and the fence shall meet regulations. During the visit pool fencing was observed to not meet regulations.
Pool regulations are as follows: per Child Care Regulation 102417(g)(5) Operation of A Family Child Care Home (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence.
Per Child Care Regulation 102417(g)(5)(A) Operation of A Family Child Care Home (A) Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate.
During today’s inspection, LPAs observed the pool fencing to be in good repair and completely surrounding the pool. LPAs observed fence to be made of black wrought iron between the pool and the home. The black wrought iron fencing was observed to have vertical rails with less than 4 inches of space between the rails. ---Page 1 of 2 |
