Licensing Program Analyst (LPA) Lilia Hernandez conducted an unannounced complaint inspection to the above facility on 03/11/2025. LPA arrived to the facility at 2:35PM and met with Debbie Heim, Director, who guided LPA on a tour of the facility. There were 24 children with 9 staff present. LPA was later met by LPA was later met by Vivian Meguerian, VP of School Operations.

The purpose of the visit is to deliver findings for the above allegations.

Information provided by the reporting party indicates that Staff #10 may or may not have violated the personal rights of children in care.

During the investigation conducted by the LPA, interviews were conducted, records were reviewed, copy of facility roster and other pertinent information was obtained.

Per Director, care and supervision is continouslly addressed with staff and continues to ensure care and supervision regulations and guidelines are being followed. Disclosures were made by the director that Staff #3 disclosed that she observed an incident between Staff #10 and Child #1. Staff #3 disclosed to Director that Staff #10 handle Child #1 in a rough manner. Photos of Child #1 were provided and no injury or marks were observed.

LPA interviewed Staff #3 who disclosed that while caring for children, Staff #3 observed Staff #10 handle Child #1 in a rough manner when attempting to make Child #1 stay near a table.

Staff #10 last day at the facility was 10/14/2024 and is no longer associated.

Based on the investigation conducted by the Department which includes interviews, observations, record reviews, and other pertinent information and documents, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

The following deficiencies listed on the attached LIC 809D are being cited in accordance with California Code of Regulations Title 22.

A copy of this report, appeal rights, and Notice of Site Visit was provided.

The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Per Director, staff will be provided with a review of personal rights, care and supervision. Director will submit via email a copy of the meeting agenda and a sign in sheet of all staff in attendance by POC due date.

Based on interviews conducted and information obtained indicating that Staff #3 disclosed that while caring for children, Staff #3 observed Staff #10 handle Child #1 in a rough manner when attempting to make Child #1 stay near a table which posed a potential health, safety, and personal rights risk to children in care.

Per Director, care and supervision is continouslly addressed with staff and continues to ensure care and supervision regulations and guidelines are being followed.

LPA conducted interviews with Staff #1 through Staff #9. During the interviews, staff disclosed concerns with Staff #10 and submitted pertinent infoirmation regarding their concerns with Staff #10. However, staff could not confirm observing or witnessing Staff #10 violating the personal rights of children in care. Staff also reported incidences that may have occured in 2023 and 2024 and did not report the incidences to the Department within the required reporting time.

LPA also conducted interviews with Parent #1 through Parent #5. During the interviews there was no information provided to support the allegation or verify the information provided in the details of the allegation.

Per Director, there were instances where staff reported concerns with Staff #10. Director disclosed that in following up on the concerns, it was disclosed that their was conflict between staff members but was not able to find evidence of children's personal rights being violated.

Based on the investigation conducted by LPA, it has been determined that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation are unsubstantiated.

The Notice of Site Visit must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
