On 12/14/2023, Licensing Program Analyst (LPA), Loyce Phillips, conducted an unannounced visit for the purpose of delivering the findings on the above allegations. LPA was greeted by Licensee, Maritza Montoya and toured the facility. LPA observed 9 children in care with 2 staff.

During this investigation, LPA documented observations, obtained documents, conducted interviews with staff, children and parents. LPA conducted interviews with parents. Based off parent interview statements, 3 parents disclosed they have picked up their children from the daycare in soiled diapers in the past but didn’t think it was a concern. Parents also disclosed they rarely received their children bedding to take home weekly for cleaning and soiled sheets would be giving to take home every so often for cleaning. Parents also disclosed they wait at the front entry door for pick-up and drop off. 1 parent stated they did not know they were allowed to go inside the facility because they were used to waiting at the door and never been invited inside the facility since the pandemic.

During inspection visit on 11/07/2023, LPA observed 2 crib sheets belonging to children with stains on and throughout the sheet. Licensee stated the stains were of body fluids. Therefore, the allegations of personal rights violation and Licensee did not allow child responsible party access to inspect the facility are deemed Substantiated.

A Substantiated finding means that the allegation is valid because the preponderance of the evidence standard has been met.

Deficiency is cited in accordance with Title 22 of the California Code of Regulations and/or Health & Safety Codes.

An exit interview was conducted, a copy of this report, appeals rights and a notice of site visit were discussed and provided to Licensee.
