On 10/31/2022 at 8:30 am Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced case management visit. LPA Ornelas was greeted by director Cherly Gartsman and granted entry into the facility. Director guided LPA Ornelas on a tour of the facility. There is an infant license (197411212) on the premises. There were 6 staff and 44 children present during the visit.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018 requires all licensed Child Care Centers (CCC’s) constructed before January 1,2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five years after the date of the first test.

Community Care Licensing was notified that lead water re-testing conducted at the facility on 10/04/2022 exceeded allowable limit for lead. Samples testing over 5.5 ppb/ug L and above is considered an exceedance. The Purpose of today’s visit is to follow up lead testing results of Action Level Exceedances (ALE) and conduct an inspection.

During today’s visit LPA Ornelas observed water facet/outlets identified on facility sketch. LPA Ornelas reviewed the outlets list on the on the water testing documents. Per the report, the following water outlets yielded the following results:

1.) A- Hand washing Sink (adult level in room 12/preschool 2): 9.02 ppb

2.) B- Hand washing Sink (child’s level in room 12/preschool 2): 9.14 ppb

LPA Ornelas confirmed with director that 1(D) out of 3 outlets is now safe to be usable and the other two outlets, A (previously I) and B (previously J) samples were identified as exceedance of lead and shall remain inoperable. LPA Ornelas observed outlets A and B to be located in room 12 Preschool 2 at the counter, a hand washing sink located at a child’s level and the 2nd outlet at the counter hand washing sink at an adult level. Per Director the Preschool 2 room (room 12) is currently not in use due to enrollment.

LPA Ornelas observed Preschool 2 room with no children, LPA Ornelas observed book fail display boards in the middle of the room. LPA advised boards will need to be removed from classroom.

During today’s visit LPA Ornelas collected copies of Facility Sketch (water faucets/outlets identified) and a copy of the email provided by testing technician with results including instructions of 3 week faucet flow procedure. LPA took pictures of faucets/ outlets.

Based on observation, interviews and sampling records it has been determined that these outlets are still out of compliance.

LPA discussed Plan of Correction (POC) with Director. Director has replaced all faucets identified with an Action Lead Exceedance of 5.5 ppb or over. A filtration water filtration system was placed underneath the sink with instructions of 3 week faucet flow procedure to run water for 30 second four times daily. Facility is scheduled for a third test of identified outlets on 11/07/2022. These outlets will remain inaccessible for use until a retest has occurred. LPA Ornelas observed signs posted stating Out of Service.

Instructions for required lead testing are outlined in PIN 21-21. This PIN which contains Written Directives, have the same force and effects as the regulations contained in Title 22 of the California Code of Regulations Care Child Centers are expected to use an Environmental Laboratory Accreditation Program (ELAP), for lead testing. Accreditation from the California Environmental Laboratory Accreditation Program, known as an ELAP laboratory, is equipped to measure the amount of lead in a parts per billion (ppb) unit of measurement.

A notice of site visit was given and must remain posted for 30 days.
