25 | On 06/06/23 at 8:47 AM, Antonio Almanza, Licensing Program Analysts (LPA), was at the licensed facility conducting an alternate inspection when the deficiency listed below was observed. LPA met with Cheryl Gartsman, Director. LPA observed 13 infant children and 3 staff providing care and supervision in rooms 1, 4, and 5.
Deficiencies observed:
At 8:47 AM, Staff 1 was observed by LPA providing care to 4 infant children in room #5 without a criminal record clearance. Staff 1 disclosed that has been working in the facility since March, works Monday through Thursday from 8:00 AM to 5:00 PM. The director is stating that she was under the impression that S1 had a criminal record clearance because they received a clearance notice from DOJ for S1. Director opened the associations for the infant license in Guardian, and it shows, S1 status as “In Process”, since 03/06/23. This will result in a Type A citation under Title 22 Regulation, Division 12, and Chapter 1 (see LIC809-D). A civil penalty will also be issued.
Each report (documenting a Type A citation) shall remain posted for 30 days along with the Notice of Site Visit (printed out during this inspection). In addition, A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months. The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.
A copy of this Report, Notice of Site Visit, and Appeal Rights (LIC 9058) were given and explained to Cheryl Gartsman, Director.
