On 07/12/2024 at 8:50 AM, Licensing Program Analyst (LPA)Katrina Chicote conducted an Unannounced Required – 3 Year inspection to the above facility. Upon arrival, LPA disclosed the purpose of the inspection and met with Licensee, Jaime Menendez, who guided the LPA on a tour of the facility. Adults in the home were discussed and all have criminal record clearance. Also present was A1, Licensee’s Husband/Assistant. There were six day care children present during today’s inspection. Licensee states that there are currently 12 children enrolled. The children's roster was reviewed and is current. Per Licensee, the facility’s hours of operation are 7:00 AM to 5:00 PM Monday thru Friday. Required postings were observed at time of inspection. Disaster drill log was also available during today’s inspection, last disaster drill conducted on 06/14/2024. LIC 126 was provided.

This is a single story home which consists of three bedrooms and three bathrooms, Kitchen, Living Room, Dining Room, and attached garage. Areas used by the children are Daycare Room 1 (located upon entry of the home), Bedroom 1 which has been converted to Daycare Room 2 (located down hallway to the right) and Bathroom 1 (located through door to the left of Daycare Room 1). Per Licensee, areas off limits to children and parents include entire rear of the home which includes Bedrooms 2 and 3, Bathrooms 2 and 3, Kitchen, Living Room, and Dining Room and attached garage. At 8:57 AM, LPA observed door to attached garage with operable child safety and an operable baby gate separating rear of the home making these areas off limits at time of inspection.

All areas identified on the facility sketch as accessible to children were inspected to ensure that they are clean and orderly with ventilation and heating for the safety of the children. LPA observed central air and heat vents through out the home. There is a working telephone maintained in the home. At 9:00 AM, LPA observed Daycare Room 1 to have walk up diaper changing table and cubbies for children's belongings. At 9:03 AM, LPA observed Daycare Room 2 with library area with soft seating available and age appropriate tables and chairs with rounded edges. Per Licensee, they provide food to children in care and use this room for eating. LPA

observed a variety age appropriate toys, free of loose and sharp parts in Daycare Rooms including but not limited to soft plush toys, music and movement toys, plastic and wooden manipulatives, and dramatic play toys (dress up and large wooden doll house). LPA observed electrical cover outlets all through the home. At 9:05 AM, LPA observed Bathroom 1 to have adequate supplies, operable equipment, and general area safety and sanitation. Licensee states children nap in both Daycare Rooms and use standard blue cots for napping. Isolation area for sick children will be in area of the home that is not being used by the children. Detergents, cleaning compounds, medications, and other items which can pose a danger to children are inaccessible. LPA observed cleaning solutions such as bleach and water spray bottles and Clorox wipes to be stored on high shelves making it off limits at time of inspection. The Licensee states that there are no poisons in the home used to kill vermin/bugs. The Licensee was advised that inaccessibility of hazards must be constantly reassessed depending on the age, size, and abilities of children in care. Personal Rights of children were observed by LPA at time of inspection.

Per Licensee, the children will have access to backyard for outdoor play. At 9:08 AM, LPA observed backyard has grass and concrete pathways with adequate perimeter fencing through-out the yard. LPA observed a variety of age appropriate toys free of loose and sharp parts available for the children such as wooden dramatic play houses, plastic ride along cars, tricycles, and shelf with manipulatives. LPA observed age appropriate tables and chairs outside under shade area and observed that all trees, shrubs, and plants are maintained. LPA observed area of backyard with heavy gym equipment that has been made off limits to children in care by perimeter wood fencing.

Licensee states she has a Pomeranian dog that is kept separate in rear off limits area of the home and is kept separate from children at all times. LPA did not observe or hear dog during the inspection. Per Licensee, there are no weapons, firearms in the home and there are no bodies of water around the premises. LPA observation did not see any bodies of water around the premises or firearms/weapons at time of inspection.

At 9:02 AM, LPA observed valve on the required 2A 10BC fire extinguisher indicates fully charged with proof of purchase receipt dated 03/21/2024. At 9:04 AM, LPA tested smoke and carbon monoxide detectors which were observed to be operable at time of inspection. LPA observed First Aid Kit available in Daycare Room 1 and Bathroom 1. The Licensee has current Pediatric First Aid and CPR valid until 07/2025 and has completed required AB1207 on 07/27/2023. Proof of immunization against influenza, pertussis, and measles was readily available during today’s inspection. A1 also has required Licensing documents in file.

The following were discussed:
Rooms that are off-limits need to be made inaccessible during operating hours. NO smoking, NO infant walkers, NO Johnny jumpers, NO saucer chairs, NO incline sleepers and any other item that falls into that category are permitted in the facility.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. During the exit interview, the LICENSEE, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

The facility was found in compliance per Title 22 regulations, there will be no deficiencies cited today, 07/12/2024.

A notice of site visit was given and must remain posted for 30 days.

Exit interview was conducted and report was reviewed with the Licensee Jaime Menendez.
