On 9/17/2024, Licensing Program Analysts (LPAs) Suzette Ornelas and Dawn Dowling conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegation. Upon arrival, LPA were greeted and let into the facility by Director, Amy Perez Pineda, to whom the reason for the inspection was announced. LPA toured the facility and observed 17 daycare children and 4 fingerprint eligible staff.

Throughout the course of the investigation, LPA Ornelas made observations, reviewed documents, conducted interviews with the Reporting Party (RP), staff and parents.

-Pertaining to the allegations that - Staff left daycare children unattended.
According to the reporting party (RP), oldest child is told to go to the restroom alone without adult supervision possibly due to not wanting to be out of ratio.

During the initial 10 day inspection on 7/17/2024, LPA Ornelas and Director walked into classroom 3 and observed children on their cots without an adult present in the classroom. Staff 2 walked in seconds after and right behind LPA and Director.

Based on the information obtained through observations and interviews, the allegation is substantiated. A substantiated finding means that the complaint is substantiated and the allegation is valid because the preponderance of the evidence standard has been met.

1 Type A deficiency is being cited on the attached LIC9099-D.

A copy of this report shall be provided to the parents/guardians of the children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parents/guardians of any children newly enrolled at the facility for the next twelve (12) months. The LIC 9224 Acknowledgement of Receipt of Licensing Reports must be maintained in each child's file immediately upon receipt from the parent.

A notice of site visit was given and must remain posted for 30 days.

Director agrees to write a decleration informing the department of what it is the center is doing to ensure children are not left unsupervised.
All staff will watch: Supervising Children in Child Care Center and provide LPA with a brief summary.

Based on observations and interviews, hildren were left unsupervised during nap time while staff escorted 1 child to the restroom. This poses an immediate risk to
the health and safety of children in care.

According to Staff interviewed during the course of the investigation,
According to Parents interviewed during the course of the investigation, they have no concerns regarding other languages being spoken at the Child Care Center (CCC). Parents stated that they although the teachers are not fluent in English, they are always able to understand them or there is always another teacher or assistant available who is able to communicate with them in the desired language.

-Pertaining to the allegation that – Day care child sustained unexplained injury while in care.
According to the RP, a child was injured at the day care in July of 2023.

According to Staff interviewed during the course of the investigation, children have been injured while in care but no serious or unusual injuries have occurred. Children are always supervised and staff assist children and provide first aid when needed.

According to Parents interviewed during the course of the investigation, some of their children have not been injured while in care and others have. The parents of children who have sustained injuries while in care stated that they are made aware of how their child sustained the injury.

-Pertaining to the allegation that – Staff did not report incident(s) to day care child's responsible party.

According to the RP, staff did not disclose information about a child's injury to authorized representative.
According to Staff interviewed during the course of the investigation, parents are made aware of injuries as soon as possible by a staff member or the director.

According to Parents interviewed during the course of the investigation, parents that stated that their children have been injured disclosed that the staff made them aware of the injury within a timely manner either verbally, via text immediately or a written report upon pickup.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.

A notice of site visit was given and must remain posted for 30 days.
