25 | On 06/11/2024, Licensing Program Analyst Adrian Risher conducted a case management inspection regarding the fencing around a body of water. LPA met with the licensee Linda Alvarado. LPA observed 6 children in care with 1 additional staff.
LPA observed an inflatable jacuzzi located in the back yard of the home. LPA observed a fence around the pool. LPA inspected the fencing to determine if it meets the requirements in the regulations. The jacuzzi is fenced per regulation. The fence is 5 ft high and the fence does not obscure the jacuzzi from view. Upon initial inspection of the fence, the gate opens away from the jacuzzi. The gate does not self-latch or self-close. LPA Risher conducted Face-time call with LPM Maureen Neal to confirm that the gate does not meet the regulation requirements. Licensee contacted the contractor to determine if the gate can be adjusted to meet the regulation requirements. No windows or doors have direct access to the pool area.
The gate was repaired while LPA was conducting the inspection. LPA observed the gate now being able to self-close and self-latch with a device no more than 6 inches from the top of the fence. The fence and gate now meet the bodies of water regulations. The jacuzzi is appropriately fenced according to the regulations. LPA conducted an additional Facetime call with LPM Neal to confirm that the gate meets the regulation requirements.
Exit interview was conducted and a copy of the report was provided. Appeal rights were reviewed and provided.
