32 | Based on observations, interviews and record review(s) conducted by Investigator Olivia Spindola of the CDSS/CCLD Investigations Branch, the allegation that the staff did not prevent child from touching another child inappropriately is found to be UNSUBSTANTIATED, meaning that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur.
On 12/04/2024 LPA Clayton returned to the CCC, observed the children, toured the classroom and conducted interviews with the staff.
LPA Clayton toured the classroom and observed where the children were resting/napping on the date of the alleged incident. LPA Clayton observed the paint to be non-toxic child safe paint (which is no longer stored the classroom).
LPA Clayton's record reviews shows the incident was reported to the CCC Director on 09/19/2024 , who then reported it to Community Care Licensing via phone on 09/20/2024 and via email on 09/27/2024 as required by Title 22 Regulations and/or Health and Safety codes.
Based on LPA's inspections, interviews, and record review the allegations that Staff did not ensure reporting requirements were followed and the allegation that Staff did not ensure chemicals were made inaccessible to children in care are found to be UNSUBSTANTIATED, meaning that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur.
Exit interview conducted and report was reviewed with Director Nara Keheyan.
LPA Clayton posted a Notice of Site visit which is to remain posted for 30 days.
