Licensee did not prevent day care child from getting injured by a dog while in care

On 1/24/2024, Licensing Program Analyst (LPA) Jeanine Lipsey made an unannounced visit for the purpose of deliver findings on the above allegation. LPA met with Licensee Elena Cua Villalta, to whom the reason for the inspection was announced. LPA toured the facility and observed seven children and one additional staff member.
Throughout the course of the investigation, LPA Lipsey made observations, took six photos, one video, and conducted interviews with seven parents and three staff members.
LPA took photos and video of six barking dogs, in the front yard before licensee put them in the house.
Licensee has four French bull dogs and two Yorkshire terries. LPA observed The dogs were behind by a six foot black metal fence that surrounded the entire property.
LPA took photos of the door, with a safety gate, separating the dogs from the children.
LPA interviewed three staff members, including the licensee, all three staff stated that the children are always separated from the dogs and the dogs are kept in the front of the house.

Six of seven parents interviewed stated that the children and dogs are separated, and the dogs are kept in the front of the house. The dogs can be seen through a side window as one enters the daycare from the back yard. All explained that they had never seen or heard of any physical injuries from the dogs. One parent expressed concerns regarding her two sons being afraid of the dogs jumping on them but did not say anything to the licensee.

Pertaining to the allegation the allegation of, the Licensee did not prevent day care child from getting injured by a dog while in care. Per reporting party one of the dogs scratched Child #1 (C1’s) face next to C1’s nose leaving a one-inch mark. The dog also scratched C1’s lip and gums causing minor bleeding.

Based upon observations and evidence obtained during this investigation, the allegation of, the Licensee did not prevent day care child from getting injured by a dog while in care, has been determined unsubstantiated. A finding that a complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred.

Notice of site visit was given and must remain posted for 30 days.
