On Friday, November 8, 2024, at 9:30 a.m., Licensing Program Analyst (LPA), Mayra Rivera conducted an unannounced complaint inspection. Upon LPA Rivera arrival, LPA observed 51 preschool children with staff #1, staff #2, staff #3, staff #4, staff #5 and staff #6 providing care and supervision. LPA met with director Angie Bustamante who guided LPA Rivera on a tour of the facility.

During the course of this investigation, LPA Mayra Rivera, conducted confidential interviews with staff, parents, reviewed relevant information, text messages and video. Majority of parents stated they have no concerns with the quality of care provided at Tutor time. During the interviews with staff all stated they were not aware of child 1 (C1) having any medical condition. Interview with C1 parent (P1) stated, wasn’t aware of C1 having any medical condition. During a text conversation dated 4/12/24 between staff #1 and parent of C1 after the first incident stated, “child was good and didn't notice her hot or upset”. P1 replied with "yeah she didn't seem sick too when I took her, but she was hot. The other text conversation dated 4/12/24 between staff #2 and parent of C1 stated, “thank you for telling me she was really hot. I think it was the heat.”

The video of the incident that occurred on 9/26/24, LPA Rivera observed, children in the classroom running and dancing around the carpet area. P1 was present in the classroom on 09/26/24 at the time of the incident. C1 was push down by C2. The video showed C1 rolled on side and positions self in fours (arms and legs position), tries to sit up on right hip then falls to the right side, rolls onto back with right leg stretch and right hand into a fist. P1 was talking to C2, when C1 falls to the floor. P1 immediately goes over to C1 lying on the floor.

Base on confidential interviews and recorded conversation the allegation Facility staff did not immediately notify child's authorized representative of incident involving child is deemed unsubstantiated. The center staff nor P1 was aware of child medical history prior to April 2024 and C1 parent was present during C1 next incident.

This agency has investigated the complaint. At this time, it is determined that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore at this time the above allegation is unsubstantiated. No deficiency given at this time.

Exit interview was conducted with director Angie Bustamante. The director was provided a copy of the appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these forms.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit made by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.
