On 02/29/2024 Licensing Program Analysts (LPA) Cristina Castellanos and Judy Laureano conducted unannounced Annual Required Inspection at the above-mentioned facility. LPAs were greeted by Felecia Keene, Facility Director for 197494381 at 8:59 a.m. At approximately 9:19 a.m. Director Summer Jointer arrived, who then guided LPAs on a tour of the facility both inside and outside.

Per Director Summer Jointer and Darren Jones, CEO of Rising Stars Academy, facility is currently not operating and have elected NOT to go inactive. Mr. D. Jones confirmed information via telephone.

The Licensee has a private school 2023-2024 affidavit. LPAs observed school aged children on the premises however licensee Darren Jones states the children are all enrolled under the private school affidavit. Licensee stated that the Department was informed regarding the private school children utilizing the licensed premises since the Pandemic March 2020.

LPAs observed the program to only be operating their private school program; K-3rd. LPAs did not observe any infants currently in the premises.

Facility has a working telephone service and LPAs confirmed the correct telephone number is on file.

LPAs toured and inspected the facility in accordance with the facility sketch; 1 infant classroom on site. In addition to the infant center the program also operates a preschool license no. 197493324 and a school age license no. 19743325. All licensed programs at site are currently not operating.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises.

Disinfectants and cleaning solutions are kept in a locked cabinet in the kitchen area, making it inaccessible to the children in care.

LPAs observed a working restroom and outdoor space. Staff records and children’s records were not reviewed due to program not having any enrollment. LPAs provided facility director with the current copy of the LIC311A Records to be Maintained at the Facility and the LIC125 Entrance Check List to use as a reference when auditing program.

Facility Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP). LPAs verified that the lead testing was completed on 09/16/2023 in accordance to the Written Directives outlined in PIN 21-21.1-CCP.



Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.
