On 10/3/2024, Licensing Program Analyst (LPA) Suzette Ornelas conducted an unannounced follow up complaint inspection for the purpose of delivering the findings for the above-mentioned allegations. Upon arrival, LPA was greeted and let into the facility by Licensee, Petra Garza to whom the reason for the inspection was announced. LPA toured the facility and observed 3 daycare children, 2 children who are the providers own children over 10 year of age and 1 staff.

During the course of the investigation, LPA Ornelas made observations, obtained documentation in the form of children’s roster, photos and conducted interviews with Staff, Parents and children in regard to the above allegations.

-Pertaining to the allegation that - Provider(s) spank day care children.
According to the Reporting Party (RP), children are spanked in care.
According to Child 5 (C5), and Child 9 (C9), they like the day care and do not get hit while in care.

According to Parents interviewed during the course of the investigation they have no concerns regarding the quality of care their children are receiving. Parents stated they have had a good experience with the provider and their children are happy and like the day care.
According to Staff (1) Staff (2), children are not spanked while in care. Staff stated that they communicate with children in care if there are behaviors that need to be addressed.

-Pertaining to the allegation that - Licensee allows smoking on day care premises.
According to the Reporting Party (RP), provider smokes.
According to Parents interviewed during the course of the investigation they have never observed any adults smoking or engaging in any inappropriate activity during hours of operation.
According to Staff (1) Staff (2) there is no smoking on the premises during hours of operation.

-Pertaining to the allegation that - Licensee allows drug paraphernalia to be accessible to day care children
According to the Reporting Party (RP), there is drug paraphernalia around the children.
According to Parents interviewed during the course of the investigation they have never observed poisons, chemicals, or other substances that can endanger a child on the premises.
According to Staff (1) Staff (2) there are no drugs or drug paraphernalia on the premises.

-Pertaining to the allegation that - Licensee cares for day care children while intoxicated.
According to the Reporting Party (RP), on occasion, licensee cares for children while intoxicated.
According to Parents interviewed during the course of the investigation, they have never observed adult
parties taking place with adult beverages and have no concerns regarding the condition in which the licensee cares for children.
According to Staff (1) Staff (2), the allegation is not true children are cared for under safe conditions.

-Pertaining to the allegation that - Licensee allows a minor to care for day care children alone.
According to the Reporting Party (RP), a minor is supervising day care children alone.
According to Child 1 (C1), and Child 2 (C2), Child 5 (C5) and Child 9 (C9), licensee is always present in the home.
According to Parents interviewed during the course of the investigation they always observe the licensee present in the home during pick up and drop offs caring for the day care children.
According to Staff (1) Staff (2) they are always present and supervising the day care children.

LPA made observation and did not observe any potential items that might endanger a child in care. LPA observed the on. off limit areas and reviewed days an hours of operation with the provider.

Based on the evidence as documented above, the allegations have been determined to be Unsubstantiated. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the allegation occurred.
A notice of site visit was given and must remain posted for 30 days.
