On 01/28/2022 at 12:30 p.m. Licensing Program Analyst (LPA) Deborah Lowe met with applicants Arshaluys Indzhyan, Mariam Khachatryan, and Director Jessica Torres. The purpose of the visit was an announce pre-licensing inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 25 children present during this inspection. This is an application is a change of ownership for 40 children, ages 2 years to entry into 1st grade. The child care center will operate Monday – Friday 7:00 a.m. – 6:00 p.m. The fire clearance was approved on 12/10/2021. Applicant has a pending applicant for an Infant License #197494974.

LPA Lowe toured and measured the on-limits areas and classrooms located at the facility. The facility has a total of 2 classrooms. Preschool building has a second story above the preschool classrooms. Second floor was observed with Director office, teacher work/ storage room, and 2 rooms that are off limits to preschool by use of the Church. No children are allowed on the 2nd floor. Children will have access to 4 sinks, 3 toilets, and 1 urinal.

Classroom measurements are:

· Room #1A = Room 1A was observed with an accordion door divider in the middle of the room. (23.25 x 23.75) = 552.19 + (23.42 x 23.17) = 542.64 – encumbered space (1.83 x 3.58) = 6.55 – (3.17 x 1.67) = 5.29

Total room 1A measurements: 552.19 + 542.64 – 6.55 - 5.29 = 1,082.99

· Room #2B = Room 1B was observed with a kitchen counter and stove/oven. Stove/oven has been made inaccessible to children. (13.42 x 22.83) = 306.38 + (5.83 x 2.05) = 11.95

Total room 1B measurements: 306.38 + 11.95 = 318.33

Total indoor activity space: 1,082.99 + 318.33 = 1, 401.32 divided by 35 sq feet = 40 children.

Outdoor Play measurements are:

Preschool outdoor play area was observed to have a chain link fence to divide area into 2 sections.

· Section 1 with swings near classrooms: (16.42 x 71.50) = 1,174.03 + (26.50 x 42.75) = 1,132.88

Section 1 total: 1,174.03 + 1,132.88 = 2,306.91

· Section 2 with climbing equipment: (21.25 x 31.33) = 665.76 + (19.33 x 16.33) = 315.66 + (6.50 x 10.17) = 66.11 + (5.75 x 8.42) = 48.42 + (7.58 x 7.17) = 54.35

Section 2 total: 665.76 + 315.66 + 66.11 + 48.42 + 54.35 = 1,150.30

Total outdoor activity space: 2,306.91 + 1,150.30 = 3,457.21 divided by 75 sq feet = 46 children.

Indoor/Children’s Area:

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair to ensure the safety and well-being of children, employees and visitors. Floors of all rooms have a surface that is safe and clean. Outdoor restroom floor is in need of repair. A comfortable temperature for children shall be maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts. Tables and chairs were observed to be meet the needs of the children. All play equipment and materials used by children were observed to be age-appropriate. LPA observed individual permanent or storage space for children’s clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, shall be free of toxic substances.

Drinking water from a noncontaminating fixture or container shall be readily available both indoors and in the outdoor activity area. Director stated they have a monthly pest control service to keep the center free of flies, other insects, and rodents. All containers used for storage of solid wastes, including moveable bins, shall have a tightfitting cover that is kept on; was observed to be in good repair; and leakproof and rodent-proof. No fireplaces were observed. Open-faced heaters were observed to be made inaccessible to children to ensure children's safety. All window screens shall be in good repair and free of insects, dirt and debris.

children were observed be stored where inaccessible to children. No poisons were observed. LPA advised storage areas for poisons shall be locked. The licensee shall maintain the following first-aid supplies in a location accessible to staff but inaccessible to children: LPA observed a current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

LPA advised a center shall be equipped to isolate and care for any child who becomes ill during the day. Director stated isolation is in the classroom away from the group of children with the Director providing direct supervision. Facility will use child’s designated cot when in isolation if needed. LPA advised the isolation area shall not be located in the kitchen area or the general-use toilet area.

Facility was observed to have two carbon monoxide detectors in the facility. LPA Lowe was able to hear a successful test. LPA Lowe observed a working telephone service on the premises.

In addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the child care center that shall, at a minimum, include the following:

The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted. Director stated wellness checks are completed daily upon drop off with temperature checks.

LPA advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). A baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

Napping:

Cots used for napping were observed to be maintained in a safe condition. Covered with vinyl or similar material that can be wiped. Director stated cots are disinfected daily with disinfecting spray and deep cleaned every two weeks. Each child brings their own bedding from home and sent home weekly for washing.

LPA observed a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

All toilets, handwashing and bathing facilities were observed to be maintained in safe and sanitary operating condition. Flooring at the entrance to the outdoor bathroom is in need of repair.

LPA advised hot water temperature controls shall be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C). LPA tested water temperature and observed water to not more than 120 degrees F.

LPA advised notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

LPA advised there shall be one toilet and one handwashing fixture, separate from and in addition to the number of toilets and handwashing fixtures required in (h) above, designated for use by children who are ill, for use by staff, and for emergency use. This toilet and handwashing fixture shall be conveniently located in relation to the isolation area. Facility does not have a separate bathroom. Facility has a bathroom with access from outside to use as isolation if needed with another available restroom indoors.

Common towels or washcloths are prohibited.

Outdoor:

LPA observed a shaded rest area for the children. LPA Lowe advised the outdoor play area shall be free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. LPA Lowe observed two circular metal pieces near the air conditioner unit that are hazardous to children. As a condition of licensure, the areas around and under high climbing equipment, swings, slides and other similar equipment shall be cushioned with material that absorbs falls. Outdoor area was observed with sand around climbing equipment and swings.

LPA advised sandboxes shall be inspected daily and kept free of hazardous foreign materials.

The playground shall be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence shall be at least four feet high.

LPA advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

Health Related Services:

Medications were observed to be kept in a safe place inaccessible to children. A refrigerator is available be used to store any medication that requires refrigeration.

The Director provided a written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given.

Food Service:

LPA advised all food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

LPA advised all foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less.

No pesticides or other toxic substances were observed. LPA advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored.

Soaps, detergents, cleaning compounds or similar substances were observed to be stored in areas separate from food supplies.

All food-preparation and storage areas were observed to be kept clean and free of litter and rubbish.

LPA advised the food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Full-day programs shall ensure that each child has a lunch. Half-day programs shall offer a midmorning or midafternoon snack. Applicants are looking into an outside food vendor to provide lunches to children.

The license shall be posted in a prominent, publicly accessible location in the center.

The center shall post a copy of the LIC 613A (9/96), PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 Emergency Disaster Plan, and LIC 9148 Earthquake Preparedness Checklist in a prominent, publicly accessible area in the center.

Menus shall be in writing and shall be posted at least one week in advance in an area accessible for review by the child's authorized representative. Copies of the menus as served shall be dated and kept on file for at least 30 days. Menus shall be made available for review by the child's authorized representative and the Department upon request.

The licensee shall post signs at the entrance to the child care center that provide the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5

Transportation:

No transportation services will be provided.

The following items were discussed:

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased

LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.

The following corrections are needed before a licensure will be considered. Corrections are due by 02/11/2022:

· Make circular metal items in ground near air conditioning unit on playground inaccessible to children.

· Repair or make a plan for access gate from walk way to playground – to ensure the safety of the children. Gate was observed to not close all the way on its own.

· Verification of appropriate age usage of play equipment on preschool playground.

· Facility Sketch update to include 2nd floor rooms and off limit areas.

· Repair tile floor at entrance to outdoor bathroom

· Repair counter tile in room 1B.

· Provide mass casualty plan of action.

An exit interview was conducted with the above items discussed and a copy of this report was provided to the Applicants Arshaluys Indzhyan, Mariam Khachatryan, and Director Jessica Torres. Applicant Mariam Khachatryan signed LIC 809. Final license determination will be made upon review by the Licensing Program Manager and correction of the above issues.
