On 10/27/2022 at 8:20 a.m. Licensing Program Analyst (LPA) Deborah Lowe met with site supervisors Jennifer Pearlman and Eliza Enbom. The purpose of the visit was an announce case management – licensee-initiated inspection at the facility to ensure that health, safety and personal rights as requires by Title 22 and Health and Safety Regulations governing California Child Care Centers will be met. There were 15 children present during this inspection. This is an application to increase the capacity with the addition of a toddler option for 43 infants, ages 6 weeks to 24 months and 12 toddler option ages 18 months to 30 months. The child care center will operate Monday – Friday 7:30 a.m. – 6:00 p.m. The fire clearance was approved on 08/03/2022.

Infant facility is located on the property of Shomrei Torah Synagogue in the second building to the north of the drive way after you pull in from Valley Circle Boulevard. Infant classrooms are located on the bottom floor. Facility has a coded entry gate to the infant facility. Second floor is occupied by a 3rd party elementary/ middle school program. There is a total of four buildings on property, one used for Synagogue and two other buildings used for 3rd party educational programs.

LPA Lowe toured and measured the needed on-limits areas and classrooms located at the facility. The facility has a total of 5 classrooms to be used for infants, rooms# 8, 9, 10, 11, and 12. Room #9 will be used as a crib room and will not be calculated into overall capacity measurements. Infants will have access to 6 sinks. Fire extinguisher was observed with a service date of 12/21/2021.

Classroom measurements are:

LPA observed no changes to rooms 11 or 12 from visit that occurred on 2/24/2022. LPA used original measurements obtained on 2/24/2022 for rooms 11 and 12 for this visit. Room 10 was remeasured due to LPA observed a new changing table added to the room. Room 8 is a new room facility is requesting to use as the toddler option room. page 1

Total Indoor Activity Space measurements for rooms 10, 11, and 12 to be used for infants: 1512.49 square (sq) feet (ft) divided by 35 sq ft = 43 infants.

Total Indoor Activity Space measurements for room 8 to be used for toddler option: 519.11 sq ft divided by 35 sq ft = 14 Toddler Option.

Facility application is for a total of 55 infants (43 infants and 12 toddler option).

Room #9 crib room was observed to have 21 cribs.

Outdoor Play measurements are:

LPA Lowe observed no changes to the overall outdoor area from visit that occurred on 3/14/2022.

Infant outdoor area is located behind rooms 11 & 12 on the North side of building.

Total outdoor activity space as measured on 3/14/2022: 2,427.47 divided by 75 square feet = 32 infants. Facility has one outdoor area for infants and toddlers. Facility is requesting a waiver for infants and toddler option to use the outdoor area with use of alternate schedules. LPA advised infants and toddler option children shall not commingle.

Indoor/Children’s Area:

Indoor activity space for infants was observed to be physically separate from space used by children in the 3rd party educational programs. Facility currently only has an infant license.

All outdoor and indoor passageways, stairways, inclines, ramps, open porches and other areas of potential hazard were observed to be free of obstruction. The child care center was observed be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. Floors of all rooms have a surface that is safe and clean. A comfortable temperature for children was observed. The infant care center was observed to be equipped with appropriate furniture and equipment including, but not limited to, cribs, mats; changing tables; and feeding chairs. Tables and chairs were observed to be meet the needs of the children. Furniture was observed to be maintained in good repair and safe condition.

The type, height and size of furniture and equipment was observed to be age appropriate. LPA advised

swings, playpens and all such equipment and furniture shall be assembled or installed according to the manufacturer's instructions and shall be maintained in good repair and safe condition. No swings or playpens were observed during visit.

LPA advised toys shall be safe and shall not have sharp points or edges or splinters or be made of small parts that can be pulled off and swallowed. Rattles shall be large enough so that they cannot become lodged in an infant's throat and constructed so that they will not separate into small pieces.

LPA Lowe observed individual permanent storage space for infants clothing, personal belongings and/or bedding. All materials and surfaces accessible to children, including toys, were observed to be free of toxic substances.

Drinking water from a Brita container was observed to be readily available both indoors and in the outdoor activity area. Director stated the Synagogue has a pest control service to assist in keeping the center free of flies, other insects, and rodents. All containers used for storage of solid wastes, including moveable bins, were observed to have a tightfitting cover that is kept on and in good repair. No fireplaces and open-faced heaters were observed at facility. All window screens were observed to be in good repair and free of insects, dirt and debris.

LPA observed disinfectants, cleaning solutions, poisons and other items that could pose a danger to be inaccessible to children. LPA advised storage areas for poisons shall be locked. LPA observed a, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

LPA Advised any infant in the isolation area shall be under constant visual observation by a director, an assistant director, a teacher or an aide. Director stated isolation area will be located in the director’s office. LPA advised the isolation area shall not be located in the kitchen area or the general-use toilet area.

Facility was observed with a carbon monoxide detector located in room 9 (crib room). Smoke detectors were observed in each room. Director tested detectors and LPA was able to hear a successful test. Facility was observed to have working telephone service on the premises.

Facility uses Brightwheel App as a sign in/out and communication method for families.

LPA Lowe reviewed with Director the facilities policy in ensuring infants with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.

LPA advised smoking is prohibited on the premises of a child care center as specified in Health and Safety Code Section 1596.795(b). LPA advised a baby walker shall not be allowed on the premises of a child care center in accordance with Health and Safety Code Sections 1596.846(b) and (c).

LPA advised there shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity. Based on the total licensed capacity, one handwashing fixture shall be maintained for every 15 infant, or fraction thereof.

Napping:

LPA Lowe observed 21 standard size crib for each infant who is unable to climb out of a crib: LPA advised Stacking wall cribs or cribs stacked one on top of another, often referred to as tiered cribs, shall not be permitted. Cribs were observed to not limit the ability of staff to see the infant.

Crib mattresses were observed to be covered with vinyl or similar moisture-resistant material. Crib mattresses were observed to be: Maintained in a safe condition with no exposed foam, batting or coils.

LPA observed floor mats that meet the requirements of Section 101239.1(b) to be provided for all infants who have the ability to climb out of a crib. LPA advised each crib, mat or cot shall be occupied by only one infant at a time. Each infant's bedding shall be used for him/her only. Such bedding shall be replaced when wet or soiled, or when the crib, mat or cot is to be occupied by another infant.

LPA advised the calculation of indoor activity space for infants shall not include space designated and used for cribs. The sleeping area for infants was observed to be physically separate from the indoor activity space in room #9.

Mats used for napping were observed to be maintained in a safe condition. Constructed of foam at least 3/4 inch thick. Covered with vinyl or similar material that can be wiped. Marked or colored so that the sleeping side can be distinguished from the floor side. Wiped with a detergent/disinfectant weekly or when soiled or wet.

LPA advised each mat shall be equipped with a sheet to cover the cot or mat and, depending on the weather, - page 4

a sheet and/or blanket to cover the child. Director stated infants provide their own bedding. All bedding is sent home once a week to be cleaned.

The facility was observed to have a variety of age-appropriate equipment, toys and materials in good condition and in sufficient quantity to allow children present to fully participate in planned activities.

Infant Changing Tables

Have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. Have raised sides at least three inches high and maintained in good repair and safe condition. LPA observed changing tables to be placed within arm's reach of a sink.

Restrooms:

All toilets, handwashing and bathing facilities were observed to be maintained in safe and sanitary operating condition. Additional equipment, aids and/or conveniences shall be provided as needed in centers that serve children with physical disabilities.

LPA advised hot water temperature controls were observed be maintained to automatically regulate temperature of hot water delivered to plumbing fixtures used by children to attain a hot water temperature of not less than 105 degrees F (40.5 degrees C) and not more than 120 degrees F (48.8 degrees C).

LPA advised notwithstanding (e) and (e)(1) above, handwashing fixtures shall not be required to deliver hot water.

LPA advised there shall be one toilet and one handwashing fixture, separate from and in addition to the number of toilets and handwashing fixtures required in (h) above, designated for use by children who are ill, for use by staff, and for emergency use. This toilet and handwashing fixture shall be conveniently located in relation to the isolation area. Staff bathroom located near the office will be used as an isolation restroom for an ill child.

LPA advised common towels or washcloths are prohibited.

LPA advised there shall be a minimum of one hand washing sink to every 15 infants and one potty chair to every five infants being toilet trained. The facility was observed with 1 child size toilet, 2 adult size toilets. LPA - page 5

Outdoor:

Outdoor activity space was observed be physically separate from space used by children in the 3rd party educational programs. Facility currently only has an infant license.

LPA observed a shaded rest area for the children. Outdoor activity area was observed to be free of hazards including, but not limited to, holes, broken glass and other debris, and dry grasses that pose a fire hazard. The areas around and under the climbing equipment, was observed to be cushioned with material that absorbs falls.

Outdoor area has a climber with slide that is gated and has been made off limits to infants in care.

LPA advised sandboxes shall be inspected daily and kept free of hazardous foreign materials.

The playground was observed to be enclosed by a fence to protect children and to keep them in the outdoor activity area. The fence was observed to be at least four feet high.

LPA advised any construction or equipment that could pose a hazard in the outdoor activity area shall be made inaccessible to children in care. This shall include, but not be limited to, incinerators, air- conditioning equipment, water heaters, and fuse boxes.

LPA did not observed any pools or other bodies of water at facility.

There shall be at least 75 square feet per child of outdoor activity space based on the total licensed capacity.

Health Related Services:

LPA observed medications to be kept in the director’s office inaccessible to children. Medications that require refrigeration will be located in small office refrigerator or in classroom #11, refrigerator is located in a child proof locked cabinet inaccessible to children.

LPA observed and reviewed written plan to record the administration of prescription and nonprescription medications and to inform the child's authorized representative daily when such medications have been given. LPA reviewed completed LIC9221 Parent’s Consent for Administration of Medication and Medication Chart. page 6

Food Service:

LPA advised prior to the infant's first day at the center, the infant care center director or assistant director shall complete a needs and services plan for the infant. High chairs or other appropriate seating equipment shall be used to seat infants during feeding. Infants who are unable to sit unassisted in a high chair or other seating equipment shall be held by a staff person or other adult for feeding.

LPA advised bottles, dishes and containers of food brought by the infant's authorized representative shall be labeled with the infant's name and the current date. LPA advised best practice when labeling bottles to include the contents of the bottle. The infant care center shall not serve honey or corn syrup to any infant.

Facility does not have a kitchen. Room #11 has a refrigerator/ freezer located in the classroom cabinet made inaccessible to children with the use of child lock on cabinet doors. Room #10 has a refrigerator/ freezer located in the classroom cabinet made inaccessible to children with the use of child lock on cabinet doors. Parents/ guardians will supply all food for infants in care. LPA advised facility to have extra food available for infants in an emergency.

All foods or beverages capable of supporting the rapid and progressive growth of microorganisms that can cause food infections or food intoxications shall be stored in covered containers at 45 degrees F (7.2 degrees C) or less. LPA observed a thermometer in the refrigerator /freezer.

LPA advised pesticides and other similar toxic substances shall not be stored in food storerooms, kitchen areas, food-preparation areas, or areas where kitchen equipment or utensils are stored.

LPA advised soaps, detergents, cleaning compounds or similar substances shall be stored in areas separate from food supplies.

LPA advised all food-preparation and storage areas shall be kept clean and free of litter and rubbish; and measures shall be taken to keep all such areas free of rodents and other vermin.

The food-preparation area shall not be used for: Children's play activities, unless such activities are part of a supervised food-education program. Full-day programs shall offer a midmorning and a midafternoon snack.

Full-day programs shall ensure that each child has a lunch. Half-day programs shall offer a midmorning or midafternoon snack.

LPA Lowe observed the following postings: the license, LIC 613A (9/96) in a prominent, PUB 393 (8/02), Child Care Center Notification of Parents' Rights Poster, LIC 610 which provides the telephone number of the local health department and information on child passenger restraint systems pursuant to Health and Safety Code section 1596.95(g) and Vehicle Code sections 27360 and 27360.5, and LIC 9148 Earthquake Emergency Preparedness plan publicly accessible area in the center.

Children will bring their own food from home. No menus were observed during visit.

LPA reviewed the facilities disaster and mass casualty plan of action. The plan was writing and was observed to be readily available. The mass casualty plan is in connection with Shomrei Torah Synagogue disaster and mass casualty plan.

LPA reviewed PIN-21-21-CCP “RELEASE OF THE WRITTEN DIRECTIVES FOR LEAD TESTING OF WATER IN LICENSED CHILD CARE CENTERS PER AB 2370” with Director’s.



Facility Representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed with facility representative the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.

To receive important licensed-related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-care-licensing/subscribe and select the Child Care option to receive email communication.

No corrections are needed. LPA advised the outdoor waiver will need to be processed before a capacity increase will be considered. Director’s provided LPA with a written outdoor waiver request and a current Child’s Roster during visit.

Notice of Site visit and appeal rights were provided.

An exit interview was conducted with the above items discussed and a copy of this report was provided to the facility representatives Jennifer Pearlman and Eliza Enbom. Final capacity increase determination will be made upon review by the Licensing Program Manager.
