On 3/21/2024 Licensing Program Analyst (LPA) Laureano arrived at above mentioned facility for the purpose of investigating the above-mentioned allegations. Upon arrival, LPA met with teacher M. and discussed the purpose of the visit. Staff informed LPA that director A. Siddiqui had stepped away and will be back soon. LPA toured the facility and observed 20 children and two staff members providing care and supervision. Director arrived at facility at approximately 12:40 p.m.

LPA toured facility and observed classroom 2 with 4 large screws protruding from the wall near two children’s crib. Cribs are not currently being used by children. LPA observed 7 children napping in cots in the same classroom; making the screws accessible to the children in care. Type B citation was issued.

LPA observed 10 napping children supervised by one staff member, two children walked to use the bathroom unsupervised. LPA observed staff leave 7 napping children in classroom while staff went to the kitchen. Type A citation was issued.

LPA interviewed director and staff member and staff and children files were reviewed.
LPA requested the following: children's roster, sign in sheet and copy of parent contract.

Based on the information received and LPA’s observation, sthere is a preponderance of evidence to prove the alleged violations did occur. Therefore, the allegations are SUBSTANTIATED. LPA Judy Laureano issued one Type A deficiency and one Type B citation during today's inspection (see LIC 9099-D for details).

An exit interview was conducted and a copy of this report along with the Notice of Site Visit and Appeal Rights were provided to facility director Asma Siddiqui.

Responsibility for Providing Care and Supervision. The licensee shall provide care and supervision as necessary to meet the children's needs. No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation.

The Director will review Title 22 Regulations Section 101229 on Responsibility for Providing Care and Supervision and develop a written Plan of Correction (POC) to ensure compliance. Written POC must be submitted to CCL by the POC 3/29/2024

This requirement was not being met as evidenced by: On 3/21/24, at approximately 12:28PM, LPA observed 2 children in the bathroom while staff supervised 10 napping children in the classroom. LPA observed 7 napping children in class room 2, unsupervised, while staff walked over to the ktichen area. This poses an immediate health, safety, and personal rights risk to children in care.
