32 | LPA Clayton conducted a thorough investigation which included facility inspections, observations, and staff interviews referencing the above-mentioned allegations. LPA Clayton heard and visually observed teachers telling children who were sitting up to “lay down, right now” and telling children who were laying down to “close their eyes and go to sleep”. LPA Clayton observed teachers patting children on the back for more than 20 minutes, to get them to fall sleep. LPA also heard staff tell children “it’s time to wake up” all of which are a violation of the children’s Personal Rights. LPA Clayton reviewed the CCC “daily diaper log” and observed dates where the children were in attendance, but there were no entries. LPA Clayton also observed that during multiple visits, the children’s diaper/toileting needs not being met until another teacher arrived at 10am.
Based on information obtained during the investigation that included LPA Clayton's observation, it has been determined that staff force children to nap, staff force children to wake up from their nap, and staff did not meet the child's diapering care needs, all of which are a violation the children’s Personal Rights. The preponderance of evidence standard has been met; therefore, the allegations are found to be SUBSTANTIATED. Type B Violations of the California Code of Regulations, Title 22, 101223 (a) (1) (3) is cited on the attached LIC 9099-D.
An exit interview was conducted, and this report was reviewed with Director Rafeda, and Appeal Rights were discussed and provided.
LPA Clayton posted a notice of site visit which must remain posted for 30 days.
