An Informal Office Meeting was conducted on 11/01/2024 at 9:45 AM, at the Palmdale Regional Office. Present during the meeting were Regional Manager (RM) George Mingle who was attending virtually, Licensing Program Manager (LPM) Mariela Ramon, Licensing Program Analyst (LPA) Annelise Villa, and Licensee, Carla Smith.

The goal of this meeting is to address recent concerns with the Operations of the Family Child Care Home and to assist the licensee to achieve and maintain facility compliance with Title 22 California Code of Regulations as it aligns with the mission of the Department.

During this Informal, we addressed substantiated violation of Reporting Requirements, an unsubstantiated finding of complaint and concerns of conduct Inimical, personal rights of children in care, and Criminal Record Clearance with licensee.

On August 26, 2024, based on investigative findings regarding allegations that involved law enforcement, the Department substantiated a violation of Reporting Requirements, as licensee failed to meet her reporting obligations. The complaint outlines an altercation between licensee and daughter which occurred when daycare children were present.

The following regulations were discussed and provided to licensee:

Reporting Requirements – The licensee shall report the following information the Department by telephone or fax within the Department's next business day and during normal working hours (8am to 5pm).

Conduct Inimical - The Department shall have the authority to suspend or revoke any license for the following reasons: conduct in the operation or maintenance of a family day care home which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of the State of California.
Personal rights: Each child receiving services To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.

Criminal Record Clearance – All adults residing/working/volunteering in the home shall obtain a California Criminal record clearance or exemption.

Operation of a Family Childcare Home- The licensee shall be present in the home and shall ensure that children in care are always supervised. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day.

Penalties - Subsequent violations within a 12-month period will result in a civil penalty of $100.00 per violation per day for a maximum of 30 days.

In response to these discussions, the licensee has agreed to the following:



The licensee shall take training on personal rights and reporting requirements.

The licensee shall ensure children are provided with a safe and healthful environment.

The facility to receive more frequent inspections to ensure the health and safety of children in care.

The licensee shall operate the facility in compliance with Title 22, Division 12 Childcare Center Regulations always.

The licensee shall watch the following training videos and complete summaries for each video on CCLD website: https://ccld.childcarevideos.org/ and submit summaries for each video to LPA Villa no later than 11/29/24:
- Background check for caregivers
-Supervising children in family child care
-Reporting Requirements
-What is a civil penalty?
-Children's personal rights in childcare-The licensee shall provide a written statement to the Department plan she would address a similar incident differently in the future. Special attention should be given to situations when daycare children are present.


It was also discussed the importance of maintaining the facility in substantial compliance. The department recognizes the potential for the licensee to rectify these issues and emphasizes the importance of adhering to Title 22 Regulations. The goal is to work collaboratively with the licensee to ensure compliance and promote the safety and well-being of the children in her care.

A copy of this report must be provided to the authorized representatives of all currently enrolled children and must also be provided to newly enrolled children for the next 12 months. The report shall be provided no later than the next business day or the next day the child is in care.

Copies of this report must be posted for 30 days in a visible location for the authorized representatives of children. Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.

An exit interview was conducted with licensee Carla Smith. A copy of the Appeal Rights (LIC 9058) was given and explained. The licensee’s signature on this form acknowledges receipt of these rights.
