On 06/05/2025, Licensing Program Analyst (LPA) Justeene Tamayo conducted an unannounced Capacity Increase Inspection. LPA was greeted by licensee Nelli Mikayelyan, who guided LPA on a tour of the facility. Upon arrival, LPA observed zero day care children in care. There are no bodies of water on the premises.

Facility operates Monday through Saturday from 7:00 am to 11:00 p.m. Licensee is requesting a capacity increase for license capacity of 14 children. A Fire Clearance has been granted effective 06/03/2025. LPA went over the child care ratios for a large family home with licensee, and provided licensee with a copy.

This is a one-story single-family home. There is a living room, dining room, kitchen, three bedrooms, two bathrooms, laundry room, and in the back yard (utilized for storage and equipment). Main care is provided in the living room and dining room referred to as the children’s play area. The off-limits areas are bedroom #1, #2, #3(child safety knob). The second bathroom near the master bedroom is also off limits.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Children utilize the bathroom located to the left from the main entrance of the home. LPA did not observe any hazardous items in the child care bathroom. LPA observed a lock on the shower handle to prevent accessibility.

The home was inspected inside and out for safety, comfort, cleanliness, service, heating, and center air ventilation. The home has age-appropriate toys, play equipment and materials. Licensee stores sharp knives in the kitchen cabinet (LPA observed a child safety gate), medication is stored inaccessible to children in master bedroom. Cleaning supplies are not accessible to children (maintained in the bottom of the laundry room as well as under the kitchen sink. The kitchen is fully barricaded by a safety gate.

Licensee has a complete Emergency First Aid Kit with a thermometer in the home, which is stored inaccessible to children. Children sleep on cots during naptime. The backyard is utilized for outdoor play and is gated all around and enclosed.

Licensee was reminded about always ensuring proper care and visual supervision.

LPA observed a fire extinguisher (2A10BC) that meets the State Fire Marshal standards, and recharged on 03/2025. Licensee tested the dual smoke detector and carbon monoxide detector, and they were found to be in operable condition.

Per licensee, there are no weapons or firearms in the home, nor did LPA observe any weapons or firearms during the inspection. Licensee also stated she does not have any animals in the home.

The Licensee's Pediatric CPR/First Aid expires on 09/28/2026. The licensee has the required immunizations against pertussis (Tdap), measles (MMR), and tuberculosis (TB). Family Childcare Orientation was completed on 10/12/2018. Preventative Health and Safety training with lead and nutrition component is dated 12/14/2024. Childcare Provider Mandated Reporter training (AB1207) is dated 8/30/2023 and expires on 08/30/2025. Fire/Disaster drill is complete and maintained current. Last Fire/Disaster drill was completed on 05/23/2025.

Licensee has a parent board and other Licensing required forms in the main care area visible to parents.

The following was discussed with licensee:
Infant safe sleep PIN, Infant Safe Sleep Plan (LIC9227) and safe sleep log were provided. Mandatory licensing forms for the children’s files, facility forms/records, and information to be posted in the family child care home; Requirements to conduct fire and disaster drills once every six months and record it; Role and responsibilities of being a mandated reporter were reviewed; Licensee was made aware that it is her responsibility to know the regulations as well as anyone who assists in providing care; Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified; Regulation prohibits the smoking of any kind in the family child care home.

Licensee was informed that all adults living in or having access to the home, or employees are required to have fingerprint clearances with Department of Justice, FBI and Child Abuse Central Index prior to having contact or working with children. If the aforementioned is not adhered to, a Civil Penalty of up to $500, per non-cleared adult will be assessed immediately. Please advise your analyst of any person who will be visiting regularly or for longer than one week. Licensee was advised to utilize the Request for Live Scan Service form LIC9163 to have adults fingerprinted and associated to the home.

The licensee was advised of the requirement to report Unusual Incidents. A report shall be made to the department by telephone or fax during the department's normal business hours before the close of the next working day following the occurrence during the operation of family day care home. In addition, a written report shall be submitted to the department within seven days following the occurrence of any events specified above. The applicant was informed to utilize the Unusual Incident Report/Injury Report form LIC624B when submitting the report to the department.

Licensee was advised that the Notice of Site Visit must be posted at the entrance of the facility for a period of 30 days whenever a licensing inspection is conducted. If a Type A deficiency is cited, a copy of the licensing report must also be posted for 30 days. The same report must be provided to parents/guardians of children newly enrolled at the facility during the next 12 months and licensee must obtain a signed Acknowledgement of Licensing Reports (LIC 9224) from parent/guardian and place it in each child's file. Copies of the reports must be provided to each parent when a Type A violation is cited along with Acknowledgment of Receipt of Licensing Reports (LIC 9224). If these requirements are not met civil penalties per violation will be assessed.

Beginning on January 1, 2018, Assembly Bill 1207 (2015) requires all licensed providers, applicants, directors and employees to complete training as specified on their mandated reporter duties and to renew their training every two years. Applicants must meet requirements as a precondition to licensure. New employees shall have 90 days from date of employment to complete training as required. The training may be conducted at the following website www.mandatedreporterca.com. This Child Care Provider (AB1207) certificate is valid for two years and it is required to renew every two years.
