32 | Allegation 1: the first allegation stated that Staff do not provide a comfortable/healthful environment for children in care. During the investigation, it was alleged children were in an uncomfortable or unhealthy environment. The investigation revealed that the facility was having construction done on the facility during operational hours and during the weekends. LPA conducted interviews and observations, there was disclosures supporting evidence that the children were showing signs of distress, including crying, during the construction. Allegations 3: The third allegation states that the facility has unqualified staff providing care and supervision to daycare children. During the observation, interviews, and record review, the following was revealed: the Licensee stated that the Directors reviewed the personnel files before hiring infant teacher staff; however, the Directors were not requesting official transcripts from the infant teacher hires. Record review showed that Staff 2 is an unqualified infant teacher that provided care and supervision as a fully qualified infant teacher at the facility without having completed any ECE semester/quarter units. Based on information obtained, observations, and interviews with relevant complaint parties, the allegations are deemed substantiated for allegations 1 and 3; as a result, two Type B citations will be issued for the allegations. A finding of substantiated means that allegations were valid because the preponderance of the evidence standard has been met. As a result of the investigation, the facility was found to be in noncompliance with Title 22 Regulations and has been cited deficiencies, see the LIC 9099D for the details.
An exit interview was conducted, and a copy of this report was provided to the Director along with the Notice of Site Visit and Appeal Rights.
