Licensing Program Analyst (LPA) Thelma Razo conducted a subsequent complaint inspection to deliver findings on the allegation of "Staff handheld day child roughly". Specifically, a staff pulled the arm of a child.
During this investigation, interviews were conducted with 6 staff, 6 parents and 7 children. All staff and children interviewed did not make a statement and have not witnessed a staff pulled a child's arm. The Director stated that the center had a training recently on October 11, 2021 regarding personal rights among other things. Five our of 6 staff interviewed have knowledge about personal rights and all staff are aware that they are mandated reporter. Parents interviewed did not disclose any concerns regarding the staff.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore at this time the above allegation is unsubstantiated.

Licensing Program Analyst (LPA) Thelma Razo conducted a subsequent complaint inspection to deliver findings on the allegation of "Staff spoke inappropriately to day care child". Specifically, it was alleged that:
1. a child will not be given a cupcake if the child does not lay down and take a nap, and
2. a child was told that the child was not making a smart choice when the child tried to climb a fence.

Two out of seven (2 out of 7) children and two out of six (2 out of 6)staff have stated that a staff made the comment that a child won't get a cupcake if the child will not lay down or the child will be given a cupcake if the child will lay down during nap time.
On the other hand, all the staff and children interviewed did not disclose any staff telling a child that the child was not making a smart choice. Parents interviewed did not have concerns regarding the staff or the facility.

Based on LPA’s observations and interviews which were conducted, the preponderance of the evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on the attached LIC9099D.
