32 | According to S1, the windows were rolled down and the air conditioning was off. S1 states that they were approximately 4 or 5 feet away from the vehicle with visual of the car while talking to the parents as they were attempting to get C3 into the vehicle. S1 also indicate that S1 was away from the vehicle for 15 minutes before returning back to the vehicle. Text messages between RP and S1 indicate S1 left the car at 8:20am and returned to the car between 8:37am – 8:40am.
According to RP, C1 and C2 were dropped off at the care facility between 5:50am to 5:55am for S1 to take them to school by 9:00am. RP was made aware, via a text message by C1, that C1 and C2 were left in S1’s car at 8:15 am while S1 went inside a house of an unknown location. This was verified by text messaging between C1 and RP. RP proceeded to access the location of C1 and C2 which was submitted as evidence. The location of C1 and C2 was at an unknown residential home located about 3 miles from an elementary school. RP took a screen shot of the location at 8:33am. Text between RP and C1 were also submitted as evidence. Texts disclosed RP asking about S1’s whereabouts, to which C1 responded at 8:23 am “ask her something. idk near a school. You can see my location”. Per interviews with C1 and C2, they arrived at the unknown location as S1 had to drop something off at a house. According to interviews with C1 and C2 , when they arrived at the house, S1 left the vehicle and entered the house for about 10 to 30 minutes. Interviews with C1 and C2 corroborated that they did not have visual view of S1. C1 and C2 also indicate that vehicle’s windows were rolled up and the air conditioning was off. The evidence and interviews reviewed found that children were left in the licensees car while S1 worked on getting C3 in her car.
Based on interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
The facility is being cited on a Type A deficiency in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 102423(a)(2). Definitions are being cited on the attached LIC 9099D pages. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). Acknowledgement of Receipt (LIC 9224 form) must be maintained in each child’s file immediately upon receipt from parents.
An exit interview was conducted and a copy of this report was provided to Pamella Johnson, Licensee along with Appeal Rights. A Notice of Site Visit was provided, Notice of Site Visit must be posted for 30 days.
