32 | Regarding allegation facility staff does not treat daycare child with respect: LPA conducted interviews with complainant, parents, children, and staff.
LPA conducted interviews with staff # 1- 4. All staff statements corroborated that their discipline policy consist of redirecting- no time out or seclusion happens. Staff # 1 disclosed that children are not discipline, they are redirected. Per Staff #2 they go down to the child’s level to talk about the situation and redirect the child, if child is not listening, they use a firmer tone of voice. Staff #3 stated that they redirect children- there’s a peace table where children can go to talk about their feelings and books available on feelings. Per Staff #3 they go through rules and provide calming activities such as playdough. Additionally, Staff #4 disclosed that they redirect the child and gives them different activities to do.
LPA conducted interviews with 10 children. Child #2, #8 and #10 corroborated that their teacher’s yell at their friends. Specifically, child #2 disclosed that teachers yell at child # 1 and child #10 disclosed that staff #3 yells at child #2.
LPA conducted interviews with parents. One parent interview disclosed that they do not like the tone of voice used by Staff #2 towards children, as they are spoken to aggressively as if they were adults. Additionally, another parent disclosed not having concerns directly about teachers, however they have noticed that their child hesitates to go with Staff #3 as they are not as warm as the other teachers.
This agency has investigated the complaint alleging facility staff does not treat daycare child with respect. Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of the evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3 (FCC) (1 DCC) number) are being cited on the attached LIC9099D.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
