Per staff interviews it was stated that the child was having a hard time crying and throwing herself to the ground and didn't want to let her mom go and staff tried to distract the child, however they didn't want to hurt the child as she was throwing herself to the ground. Staff had advised the parent to keep her child for the day, that it might be best to take the child home as she is having a hard time right now and she will also give the teacher's a hard time.
LPA received and reviewed then schools suspension and expulsion policy and it states, except in specific circumstances listed below, Montessori Academy of West Covina School shall not:
1) Suspend a child due to a child's behavior.
2) Encourage, persuade, or require a child's parents or legal guardian to prematurely pick up a child due to a child's behavior before the program day ends.
Even throw the word suspension was not used, the staff did advised the parent and said it might be best to take the child home. The suspension policy also states suspension will be used as a last resort in extraordinary circumstances when there us serious safety threat that cannot be reduced or eliminated without removal of the child.
Based on LPA interviews conducted and documents reviewed and received, the preponderance of evidence standard has been meet, therefore the above allegation is found to be SUBSTANTIATED at this time. A type B citations is being cited as it is not an immediate risk(s) to the health, safety, or personal rights of children in care. California Code of Regulations 101219 (f) Admission Agreements: The licensee shall comply with all terms and conditions set forth in the admission agreement. A type B citation is being cited on the attached LIC 9099D.
