Licensing Program Analyst's (LPA) Judy Mora and Mary Silva conducted an unannounced annual required inspection at the above facility on 05/11/23 at 11:00 AM. Licensee required licensing staff wear shoe covers and gloves. Prior to being let into the home, the Licensee was going to spray licensing staff with Lysol with an infant in her arms. LPA Mora asked to set the baby down prior to spraying Licensing staff. Licensing staff met with Zenobie Marshall, Licensee who guided licensing staff on a tour of the facility. Three children were present during the visit. Per Licensee, there are 8 children currently enrolled. Facility hours are Monday-Saturday 4:00am-12:00am. Per licensee overnight care is provided.

Family members residing in the home are the Licensee (criminal record clearance on file), adult Zaina Cummins and 1 minor child. This is a 2 story home which consists of 3 bedrooms, 1 1/2 bathrooms, kitchen, laundry room, living room, dinning room, garage, front yard, backyard (fenced). The children do not have access to the shed, and 3 bedrooms and one bedroom. Children have access to 1/2 bathroom, and living room.

During the inspection licensing staff observed sprays and candles in a closed container on the living room floor next to the couch which was accessible to children, the stairway to the second floor had no barricade making the upstairs area accessible to children in care, towards the end of the visit licensee was aware she had a gate and placed the gate to barricade the stairs. Licensing staff observed a walker in the living room, it was her granddaughter and put it away in the closet. Licensing staff also observed a play yard in the living room with an infant propped up on a pillow, plushy ball toy and bottle were inside. Licensing staff observed knives on the kitchen counter and raid in the cabinet under the kitchen sink. LPA Silva informed licensee that any poisons need to be locked and made inaccessible to children in care. During this visit licensee removed the knives and placed them up high in a containers in addition the raid was put outside in a shed.

There is central air and heating. There is a land line in the home. Smoke and carbon monoxide detectors were tested and are operable. LPA observed a Fire extinguisher size 2A-10BC, per licensee has volunteered to purchase new fire extinguisher and maintain receipt of purchased.

Currently children use backyard for outdoor play. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that could be hazardous to children in care.

LPA observed the following required posted documentation: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form. LPA reviewed facility records for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan. A drill has not been conducted in the last six months, as there has not been any children enrolled in the last six months.



Isolation area for sick children waiting to be picked up will be in the living room, away from the other children. Per Licensee there are no firearms or weapons stored in the home.

Infant Care: The facility is currently caring for infants under 12 months. LPA informed licensee of the new Safe sleep regulations, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months.

Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, LIC 9227- Infant sleep form (0-12 months, and documentation of 15-minute Infant Sleep Check (0-24 months). Children's records were observed to be complete.



Licensee's records were reviewed for approved Pediatric First Aid and CPR certification, the Licensee's certification expires 06/2023. Licensing staff reviewed the LIC 508- Criminal Record Statement, Proof of immunization's against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse.

AB1207 Mandated Child Abuse Reporting – Implementation was discussed with Licensee. Website provided: http://mandatedreporterca.com. The Licensee will complete the training.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a plan for providing IMS must be submitted to the Department. To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage athttps://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Upon receipt of this report, the licensee shall post ANY licensing report documenting a type “A” citation. This must remain posted for 30 days during hours of operation. In addition to posting this report, the licensee will also provide copies to the parents of the children in care for up to one year. A copy of the LIC 9224 - Acknowledgement of Receipt of Licensing Reports was provided.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
