Licensing Program Analyst (LPA) Veronica Martinez Garza conducted an unannounced Case Management Incident inspection at the above facility on 03/26/26 at 08:50 a.m. The purpose of this inspection is to follow up on an incident reported to the Department with 24 hours on 03/23/26. At 09:00 a.m., LPA met with the facility representative who guided LPA on a tour of the facility and census was taken. According to the facility representative there are 16 preschoolers enrolled; however, 4 were absent today. Supervisor Queta Morales later arrived and assisted LPA with the inspection.

During this inspection, LPA interviewed Staff 1 (S1 thru 2) and Child 2 (C2).

On 03/20/26 during dismissal at approx. 2:20 p.m. child #1 (C1) was in the area where children have their meals and conduct other activities when C1 was observed to grab a chair and placed it over his head. S2 redirected C1 to put the chair down. C1 then shouted no and ran towards the large group/circle time area. As C1 was running he tripped and fell hitting the wooden border of the bulletin board which caused him to cut his left eyebrow. S2 provided first aid and at the same time the parent of C1 was walking in to pick him up. The parent of C1 informed the staff that C1 would be taken to the hospital. The nurse and facility supervisor were contacted regarding C1s injury and the nurse advised the parent to seek medical attention. Staff provided the parent of C1 with an ouch report and head injury report.

Interviews conducted with S1 revealed that C1 picked up a chair and placed it over their head. Per S1, S2 redirected the child by placing the chair down and also removed the chair from the child. S1 stated that C1 became upset said “no” and ran across the room while S2 reminded C1 to use walking feet. S1 then observed that the child tripped, fell, and hit his head on the wooden frame under the board of the circle time area. According to S1, S2 provided first aid to C1 while the parent of C1 arrived at the facility to pick him up.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Per S1, parent of C1 was given an ouch report and head injury report. Interview conducted with S2 revealed that C1 picked up a chair and placed it over their head. S2 grew concern that the child may injure himself or other children and attempted to redirect the child. Per S2, they removed the chair from C1, but the child yelled “no.” Once the child yelled no he began to run across the room where he then was reminded to use walking feet. S2 then observed that C1 tripped with his own feet, fall, and hit their head on the wooden frame of the board in the circle time area. Per S2, they attempted to clean the area, but the child did not allow staff to clean the area or apply pressure. S2 also stated that while attempting to provide first aid the parent of C1 walked in and S1 notified the parent of the incident and an ouch report and head injury were provided. Per S2, parent stated that the child would be taken to the hospital.

LPA couldn’t interview C1 since the child has not returned to the facility. LPA also attempted to interview C2; however, the child declined LPAs interview.

According to S1, parent of C1 provided a doctor’s note on 03/20/26 which was then forwarded to the nurse. Per S1, the facility had a meeting with the multidisciplinary team (MDT) and the parent of C1 to create a mental and behavior plan. As of today, C1 has not returned to the facility due to needing a doctor’s clearance. Once C1 receives a clearance from the doctor the facility will also create a health plan.

During today’s inspection, LPA obtained copies of the ouch report and head injury. LPA also obtained a copy of the hospital visit dated 03/20/26. LPA toured the area of where the incident occurred and observed that the facility has age-appropriate toys, materials, and equipment for children. LPA also observed that the board in the circle time area did not display any hazards.

At this time, the licensee is in compliance with California Title 22 Regulations. Therefore, there are no citations being issued today.



The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative, a civil penalty of $100 can be assessed.

An exit interview was conducted, and a copy of this report was provided to the facility representative Queta Morales.
