An unannounced, in-person, follow-up Complaint inspection was conducted on 03/16/22 by Licensing Program Analyst (LPA) Emiko Bell. Upon arrival, LPA was greeted and let into the facility by Director Arpin Hovanessian, to whom the purpose of the inspection was announced. The purpose of this inspection was to provide the findings of the Complaint investigation.

The COVID screening questions were posed to Director Arpin Hovanessian. Throughout the duration of the inspection, staff and LPA wore face coverings as a precautionary measure against COVID-19.

Upon LPA's arrival, Director informed LPA that there were pre-school children on the premises.

Throughout the course of the investigation, interviews were conducted with four staff, six parents, three adults, nine children and the Reporting Party; and documentation in the form of two Child Care Facility Rosters, a police report, two photos, and a Child Abuse Hotline Referral were obtained.

-Pertaining to the allegation that “Staff mishandled a daycare child while in care,” the allegation pertains to an incident which allegedly occurred on December 16, 2021 when a Preschool child (Child #1/C1) was approaching a teacher while the teacher was holding a baby and the teacher pushed and yelled at the child.

No disclosures were made by any of the four staff interviewed.

No disclosures regarding children being mishandled were made by any of the six parents interviewed.

No disclosures regarding children being mishandled were made by five of the nine children. Three of the children had observed the red mark on the face of C1 on the date in question. One child said that C1 had disclosed that it was a teacher who had hit them, causing the red mark, but the teacher was not named. The remaining four children allege that Staff #1 (S1) pull children’s arms and hair, twist their fingers and pull their ears and that on one occasion, when S1 pulled a child by the arm, they swung the child, causing them to bump their head on the door and it seemed to have been done on purpose to get the child to calm down. One of the children was told about an incident where a school-age child allegedly had been giggling while being transported in the school van and was pulled by the arm by S1 and swung around, causing the child to hit the van, and the child began crying.

Two of the three adults interviewed disclosed separate occasions when C1 sustained a bruise or red mark on their cheek and a red mark on their head by their eyebrow. Photos of the red mark/bump bruise were provided to LPA. Adult 3 was told about C1 stating that they had been hit by a teacher. The Reporting Party disclosed only that C1 may have been pushed and/or

pinched prior to the 12/16 incident.

The photos clearly show that C1 sustained a red mark/bump/bruise on their head; however, the photos were taken on 08/25/21. S1 had provided an explanation to A1 that C1 had tripped and hit their head on a desk. Though four children allege that S1 pulls children’s arms and hair, twists their fingers and pulls their ears, as the dates and children to whom this occurred is unknown and as there were no witnesses to what occurred to C1 on any of the three occasions mentioned and no disclosures were made by C1, the allegation that “Staff mishandled a daycare child while in care” has been determined to be Unsubstantiated.

This agency has investigated the complaint alleging that “Staff mishandled a daycare child while in care” and that there was a violation of Title 22, Division 12, Chapter 1, Article 6, Section 101223 Personal Rights. Based upon the evidence as presented above, the allegation has been determined to be Unsubstantiated. A finding of Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur.

No deficiencies are being cited for the allegation listed above.



A Notice of Site Visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Two of the three adults interviewed, as well as the Reporting Party, state they were informed that Staff #1 (S1) yells at the children and that S1 had even yelled at Adult #3 on one occasion.

Six of the nine children interviewed stated that S1 yells at all of the children, regardless of age, and one child mentioned that S2 also yells at children. Three of the children witnessed S1 yelling at C1 on 12/16/21 and informed A3 of this. Per S1, they speak in a firm voice and that occasionally, S2 may speak loudly and it may appear as if S2 is yelling. However, during the 02/23/22 inspection, S1 yelled at pre-school children and at S2 in front of LPAs Bell and Kurdoglyan.

When asked why S1 yells at children, four of the children stated that S1 always wants the children to sit down, be quiet and not move, whether it’s in the van while being transported (for the school-age children) or in the auditorium after drop off or before pick up time or even while playing. Per A3, after being confronted about yelling, S1 will stop yelling at the particular child about which S1 was confronted since S1 now knows that the parent is aware; per C7, it appears

as if S1 yells at the children whose parents are unaware that S1 yells or who do not confront S1 about yelling at children.

Based upon LPAs’ own observations, as well as the disclosures made by the two adults, six children, and the Reporting Party, the allegation that “Staff yelled at a daycare child while in care” has been determined to be Substantiated. A finding of Substantiated means that the preponderance of evidence standard has been met. California Code of Regulations, Title 22, Division 12, Chapter 1, Article 06, Section 101223 "Personal Rights" is being cited on the attached LIC 9099D.

Please refer to 9099D for documentation of deficiencies.

A Notice of Site Visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA Bell informed Director Arpin Hovanessian that this report dated 03/16/22 documents one Type A citation(s) which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Bell informed Director Arpin Hovanessian to provide a copy of this licensing report dated 03/16/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly-enrolled parents/guardians for 12 months from the date of this report.
