Licensing Program Analysts (LPAs) Austin Estrada and Susann Sanchez conducted an unannounced required one year inspection on 04/19/23 at 1:00 AM. LPAs met with Shannon Batista, director who guided analysts on a tour of the facility. This is an infant program which consists of one classrooms. Facility operation hours are Monday to Friday from 6:30 AM to 6:00 PM. This facility also has a Preschool component, facility #198015583 and school-age component #198015820.

All areas identified on this report were inspected. Upon arrival, the following staff were present during this inspection: Room 1: S1, S2, and S3 with 12 infants. Teacher-child ratios were observed to be in accordance with Title 22 Regulations. Classroom were observed to ensure that infants are never left unattended. All children were observed to be under visual supervision of a teacher at all times.

LPA observed required posted documentation which included, Facility License, Publication (PUB) 393- Notification of Parent Rights, Licensing Form (LIC) 610- Facility Disaster Plan, PUB 269- Child Passenger Restraint System, and LIC 613A- Notification of Parent’s Rights.

The following was observed during the tour of the facility: Children's roster was reviewed and is current. Sign in and out sheets were reviewed to ensure that the person who signs the child in and out uses their full legal signature and records the time of the day. Children present were signed in. Disaster drill log was available, last drill was conducted on 03/23/23. LPAs observed required licensing documents posted on bulletin board in the lobby.

Indoor space is separate from other child care components. Furniture and equipment were inspected for age appropriateness and good repair. Toys were observed to be safe, and do not have sharp points, edges, splinters and are not made of small parts that can pose a choking hazard.

Based on observation, interview and record review, the licensee did not comply with the section cited above. LPAs asked to see the 15 minute sleep log. Both staff and administrator stated that they thought that the sleep log was only for children under 12 months which poses a potential health, safety or personal rights risk to persons in care.

LPAs did not observe any baby walkers or any items that fall into that category present in the facility. All materials and surfaces accessible to children are toxic free. All indoor classrooms were inspected to ensure that the floors have a surface that is safe and clean.

Children have their own cubby to store their belongings. Napping equipment were observed in separate storage areas. LPAs observed wooden cribs used for younger infants and mats with sheets used for older infants. Linens are washed weekly by staff. Age appropriate sinks and toilet were inspected for availability and good repair in all restrooms. General sanitation was observed. LPAs observed that infant changing tables have a padded surface no less than one-inch-thick and are covered with washable vinyl or plastic. The infant changing tables have raised sides that are at least 3 inches high. LPAs observed that infant changing tables are within an arm’s reach of a sink.

Telephone service, heating, lighting and ventilation were evaluated and are in operating condition. Per Administrator, the isolation area is located in the office. Parents are contacted immediately when children are determined to be ill. Indoor drinking water is readily available via puncher. First Aid supplies were observed in each classroom.

Disinfectants, cleaning solutions, medication and other items that are dangerous to children, were observed to be inaccessible. According to the Director, medication is only administered to a child when accompanied with a doctor's note and is stored in the child's classroom inaccessible to children with the child’s name and date. Director states that there are no poisons stored at the facility and understands that storage areas for poisons must be locked not just inaccessible. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements.

Menus were reviewed to ensure that they are being posted at least one week in advance and visible to an authorized representative. The facility provides breakfast, AM snack, lunch and PM snack for children who eat table food (per needs and service plan). Bottles, dishes, and containers of food brought by the infant’s authorized representative are labeled with infant’s name and the current date.

All kitchen areas/food preparation areas and food storage areas are kept clean and are free of litter, rubbish, rodents, and/or any other vermin. All storage containers for solid waste, including moveable bins have tight-fitting covers that are kept on, and in good repair. All foods/beverages are stored in covered containers at 45˚ (F) or less.

Outdoor space is physically separate from other child care components. Outdoor play equipment was observed to be in good condition, free of sharp, loose or pointed parts. Outdoor activity space surface is maintained in a safe condition as is free of hazards. Areas around and/or under climbing equipment, swings and slides have cushioning material to absorb a fall. The outdoor area has adequate shade. The administrator states that there are no bodies of water on the premises and LPAs did not observe any bodies of water during this visit. Administrator states there are no weapons or firearms on the premises.

All individuals present have obtained a criminal record clearance or criminal record exemption. There is at least one person trained in CPR and Pediatric First Aid present during this inspection. Staff Records were reviewed to ensure that a health screening report is on file. Infant Teachers files were reviewed to ensure that teachers present are qualified. Staff records were reviewed at for approved Pediatric First Aid and CPR certification, LIC-501: Personnel Record, LIC 503- Health Screening, LIC 508- Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse, and Transcripts.

Children’s records were reviewed at for Immunization Records, Licensing Form (LIC) 627- Consent for Medical Treatment, LIC 700- Identification and Emergency information, LIC 995 Notification of Parents’ Rights, LIC 701- Physician’s Report, LIC 613A- Personal Rights, LIC625- Needs and Service Plan, and LIC 9227 Infant Sleep Plan.

At around 1:00pm, LPAs asked to see the 15 minute sleep log. LPAs only observed 3 infants being logged in. Both staff and administrator stated that they thought that the sleep log was only for children under 12 months.

During inspection all children were observed to be treated with dignity and respect, they were observed to be receiving safe, healthful and comfortable accommodations, furnishings and equipment, and free from corporal and/or unusual punishment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. Facility representative was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Also during inspection, LPAs took measurements of the infant classroom to update the file.

Based on the LPA’s observations and records review, the following deficiency listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiency that are being cited need to be cleared to protect the children’s health & safety.

Exit interview conducted and report was reviewed with the Mona Sangani, Administrator. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
