Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced complaint inspection to deliver findings for the above allegation. LPA met with Director, Cynthia Alvarez to whom the reason for the visit was explained. Census was taken. Upon arrival, there were fifty seven (57) children being cared for by seven (7) staff.

During this investigation, LPA conducted interviews with ten (10) staff, six (6) day care parents, and three (3) children in care. LPA Babcock also obtained documents related to the complaint allegation, including but not limited to, a copy of the Facility Roster (LIC 9040), Personnel Report (LIC 500), and Ouch Reports for Child #1.

Allegation #1: Staff did not prevent child in care from leaving the classroom without staff supervision

The complaint alleges that a child in care was able to leave the classroom and play area gate unsupervised and the child repeatedly left the classroom/play area to go to the playground used by older children.

During interviews conducted, Staff #3 stated Child #1 (C1) was able to open the gate and C1 would run off to the big playground and get out. Staff #3 additionally stated, "We were on the playground and they are quick. We put a carabiner on the gate and that stopped it happening". Staff stated when the teacher would open the classroom door to go outside, C1 would run out the door. Staff interviewed stated they immediately followed C1 when they left the classroom or play area and C1 was never out of site and was under visual supervision of staff at all times. Staff placed a carabiner on the gate and a child safety gate blocking the classroom door to prevent C1 from eloping to the playground. Staff stated the parent of C1 was notified when C1 left the classroom or play area.


Allegation #2: Child in care sustained unexplained injuries due to staff neglect/lack of supervision

The complaint alleges that a child in care experienced unexplained injuries including bites, scratches, open wounds, bruises, and facial swelling at the facility and believes their child received the injuries due to lack of supervision by staff. Complaint states biting continued for over a year and staff could not provide an adequate explanation of why they were not able to stop their child from being bitten.

LPA Babcock conducted interviews with staff, parents, and children at the facility. During interviews conducted all staff stated the facility procedure for biting is to fill out a biting report for the child that bit another child, and an ouch report for the child that was bit. Staff stated the facility has a biting policy which states "if a child is biting consistently for more than 2 weeks (or 3 incidents within a week) the parents will be

asked for support at home to help end the biting. If the situation doesn't improve immediately, a parent conference will be scheduled. If the parents of the biter do not support the conference, the child will be disenrolled from the program." All staff stated they abide by the biting policy. LPA reviewed children's files and did not observe any children who were biting others for over a year. LPA did observe files with signed biting policy forms. LPA observed the facility appears to be following their biting policy. All staff interviewed stated they provide visual supervision of children in care at all times. Parents interviewed stated they were satisfied with the care, supervision, and treatment of their child at Lad N Lassie. Technical Support Program was offered to facility and accepted by Director.

Complaint also expressed concerns about lack of outdoor play/physical activity and stated that children were not taken outside even though weather permitted. During interviews conducted, all staff stated children are always taken outdoors every day unless weather does not permit outside play.

Complaint also expressed concern that parent was told by staff their child ate their lunch when they had not, parent was not notified of a party and their child had eaten food during a party without parent consent. During interviews conducted, all staff stated there has never been a time that a child was given food from a party or through other means without parent consent. Staff stated parents are notified how much food their child has eaten on the Daily Report given to parents at the end of the day. All staff stated parents are notified of a party ahead of time. All parents interviewed stated they are notified by the facility if there will be a party for their childs classroom or that Lad N Lassie will be providing food for children to eat. All parent interviewed stated they are always notified of what food will be provided and the ability to let the facility know if parents do not want their child to eat the food that will be provided for the party or other occasion.

Complaint also expressed concern regarding picking up their child with dirty hands, face, and clothing. Staff interviewed stated children's hands are washed throughout the day, before and after meals, after outdoor play, if staff see they are dirty, or prior to going home. Parents interviewed stated they do not have any concerns with their child’s hands, face, or clothing being dirty while at the facility. LPA Babcock did not observe children's

hands, faces, and clothing to be dirty during complaint inspection visits on 1/30/26, 2/5/26, 4/22/26, and 4/23/26. Children interviewed stated they wash their hands before and after they eat and after outside play.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

There were no deficiencies cited on the above-mentioned allegations per California Code of Regulations Title 22.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Allegation: Staff did not follow reporting requirements

The complaint alleges a child in care received scratches, pinch marks, and bite marks and did not receive an ouch report for the injuries.

During interviews conducted, Staff #7 stated they have heard of an injury not being reported to parents. LPA asked parents interviewed if when their child has an injury at Lad N Lassie which is more than a minor scrape, are they provided with an Ouch Report for the injury. Parent #3 stated, "There was one time my child had a little accident and no one informed me and I had to do a little investigation and ask the questions. I never received a report but eventually they did tell me what happened". Parent #6 stated, "I don't receive an ouch report all the time. My child had a big cut on their elbow and it was maybe an inch long and had been bleeding. I did not get an ouch report for that".

Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.

A notice of site visit was given and must remain posted for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
