Licensing Program Analysts (LPA) Cynthia Reyes conducted an unannounced site inspection to present the findings of the above complaint allegations. This inspection is to ensure the health and safety standards as required by the regulations governing child care centers are met. LPAs met with Florence Banda, Director, who provided a tour of the day care indoors and out. LPA observed 5 staff with 18 infant/toddlers.

During the course of this investigation, LPA conducted Interviews, received and reviewed documents and LPAs own observations.

Personal Rights- Staff did not follow safe sleep requirements: Per reporting party (RP) an infant was found asleep on the open floor with other children all around her. (RP) reports the school policy states a baby shall sleep in a crib. Per interviews conducted with current and former staff members, the incident did occur where the baby fell asleep and was placed on the carpet and the staff member who did that was attending to another child before placing the baby in the crib, when the parent observed her child asleep on the floor.

Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

LPA Cynthia Reyes informed Florence Banda, Director that this report dated 05/15/2025 documents 1 Type A citation. Type A citation which shall be posted for 30 consecutive days as there is immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Reyes informed the licensee to provide a copy of this licensing report dated 05/15/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

The notice of site visit was posted where the parent/guardian of children enter and exit the facility. This notice shall remain posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.

Staff did not meet the needs of the day-care child- Rp reports none of the employees were able to account for her child's day activities and that it was more alarming that not one employee was able to let the rp know when her baby was changed, fed, or how she was overall. Per interviews and observations it was stated that the school uses the tadpole application to document as well as send photos to parents regarding the daily activities of their child. LPA also was told during interviews that staff entered the daily activities in tadpoles for this child, however other interviews stated that the parent was not in the tadpole system at that time and it was probably a written document of the daily activities given to the parent. No proof of the daily activities was provided as the school does not keep copies. LPA did observe documentation is also done in written and also used as back up if the tadpoles application is not working.

Staff mishandled a day-care child's personal belongings- RP stated the child's first day no one was able to give her child's personal belongings due to them being misplaced. Rp also stated that the staff, all said it was their first day, they just went in to cover a shift, and had no idea. Per interviews it was stated that the staff will hand the parents the child personal belongings if they don't want to put the booties on their shoes and just stand at the entrance of the classroom or some parents will come in the class room and grab the child's hanging bag and get other items from the child's cubbies them selves. interviews stated they handed the child's belonging to this parent on the day the parent notice her child asleep on the floor. Staff also stated they never told any one if they were a new staff or that they didn't know as the staff will communicate to each other about each child when they switch shifts. Parent then returned another day to gather the rest of the child's belongings because she dis- enrolled her child after only one day in care.

Although the allegations may have happened or is valid there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegations are unsubstantiated.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00. Appeal rights were provided.
