This inspection was conducted in English and Spanish.
Licensing Program Analyst (LPA) Anthony Padilla conducted a unannounced Annual Inspection on 8/16/24. LPA arrived at the facility at 12:20pm and met with Staff (S2) who said licensee is currently not at facility. S2 called licensee and informed LPA that licensee is 5 minutes away and will return soon. 12:35 Licensee arrived at the facility and granted LPA access to facility. LPA explained the purpose of the inspection to licensee and provided the inspection Entrance Checklist, LIC 126. LPA inspected rooms/areas on the facility sketch in which child-care services are provided and to which children have access. There were 4 children present including 2 infants. Also present was S2, (Licensee Assistant). All adults present have obtained background clearance and are associated to the facility.
Per Licensee the hours of operation are 24 hours 7 days a week. Currently children are in care from 7:30am-12:30am Monday - Sunday. LPA discussed with Licensee overnight care regulations.

This is a one-story home which consists of 3 bedrooms, 2 1/2 bathrooms, living room, kitchen, and detached garage converted into a storage room. Child care conducted in living room and Children have access to 1/2 bathroom located by the living room and fenced front yard which is used for outdoor play. Areas off limits include: 3 bedrooms, 2 bathrooms in the bedrooms, and garage (adjacent to the children's play yard) and the kitchen. Kitchen is made inaccessible with child proof gate blocking entrance for children to enter.

Per licensee she does not have any weapons or fire arms at facility. LPA did not observe any fire arms or weapons during time of inspection. Licensee stated she had 2 fire arms but submitted them to local police department and provided proof of submission to previous LPA.

Currently, children are using the front yard for outdoor play. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that could be hazardous to children in care. Facility does not have bodies of water on the premises. Licensee has pets at the facility. Licensee has pet birds located near the outdoor yard in bird cages. Per licensee children only observe birds but do not interact with the birds. Page 1

LPA observed fire extinguisher located in the main day care space for children in care to be fully charged. LPA did not observe a receipt or service tag. LPA reminded licensee a new extinguisher must be purchased or serviced yearly. At 1:15 PM LPA issued a Technical Violation (TV) to licensee for not having proof of yearly purchase or renewal for fire extinguisher. LPA observed fire drill log and observed facility completed a fire drill on 8/16/24

LPA reviewed 3 Children’s records for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, and documentation of 15-minute Infant Sleep Check (0-24 months). AT 1:30 a Technical Violation (TV) was issued for C3 not having current paperwork on file. Licensee stated child started today (8/16/24) and will have parent return completed paperwork.

Staff records were reviewed for approved Pediatric First Aid and CPR certification, LIC-501: Personnel Record, LIC 508-Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunization against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate. Licensee mandated reporter training expires on 7/22/26 and EMSA pediatric first aid and cpr expires on 5/20/25. At 1:50 LPA issued a Technical violation (TV) to licensee for S2 not having proof of Mandated reporter training certificate on file. S2 certified needs to be renewed bi-yearly and expired on 7/2024.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE FRANCIS TOMAS, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

At this time, the licensee is in compliance with California Title 22 Regulations. Therefore, there are no citations being issued today.

A notice of site visit was given and must remain posted for 30 days.
