At 1:30 pm Licensing Program Analysts (LPAs) Nolan Tcheng and Saul Valenzuela conducted an unannounced required inspection to the above facility. A risk assessment was conducted upon entry. LPAs met with assistant Xialong Yuan who guided analysts on a tour of the facility. Licensee, Tzu Man Yu was not available upon LPAs arrival as licensee was off premises. At 3 pm, Licensee arrived at the facility. Per Licensee, there are 12 children enrolled. A current children’s roster was available for review. There were 12 children present upon arrival- 2 being infants. The licensee is observed to be operating within the license capacity limitations.

The licensee states that 2 adults and 2 children currently live in the home. Per Licensee, they currently have 2 assistants. 3 adults present in the home have obtained a criminal record clearance or exemption prior to working, residing, or volunteering in the licensed childcare home. At 2:20 pm, LPAs met with Peiyu Lee who identified as the second assistant. LPAs verified on Guardian that Peiyu Lee does not have an active Criminal Record clearance associated to the above facility. Licensee stated that Peiyu Lee started working at the facility on 10/29/2022. A civil penalty has been accessed. Licensee states that there are no firearms stored in the home.

This is a one-story home which consists of 3 bedrooms, 2 bathrooms, 2 living room, kitchen, detached garage and backyard (fenced). LPAs Valenzuela and Tcheng did not observe a fireplace.

Areas accessible to children were inspected as follows: 2 living rooms,1 bedroom, bathroom in the hallway, and back yard.

Per licensee, areas off limits to children and parents include kitchen, 2 bedrooms, bathroom in the master bedroom, front yard, and detached garage. The LPAs toured all areas used by children during this visit.

At 1:50 pm, LPAs observed an infant to be sleeping in a crib with a blanket. LPAs advised licensee to remove blanket from crib. LPAs discussed safe sleep regulations with the licensee.

All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness. There is telephone service via a cellphone that stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. The restroom that children use was observed to be safe and sanitary.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 5/23/23, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months and document the date and time of each drill. At 3:20 pm, Licensee notified LPAs that she has not documented fire and disaster drills.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the living room / day care.

The home is observed to be clean and orderly. There are toys available for children. Appropriate sleeping arrangements cots and cribs were observed.

LPAs did not observe the following items during the inspection: Infant Walkers, Johnny Jumpers, Saucer Chairs, Trampolines and/or any other item that fall into these categories are not permitted in a family childcare facility.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPAs observed that the outdoor yard has toys and other materials for children to play with. LPAs did not observe any objects that can pose a danger to children on the outdoor yard. There are no pets on the premises.

At 2:00 pm, LPAs observed that licensee and other personnel do not have current proof of completed training on First Aid and CPR. LPAs observed the licensee's Pediatric First Aid and CPR expired on 3/2024 and assistant Pediatric First Aid and CPR expired on 5/2023. There are first aid supplies available.

At 2:30 pm children’s records were reviewed, including emergency information and the following were observed. C1, C2 and C3 are missing current proof of immunization in their files. LPAs observed C4 and C5 are missing sleep logs in their files.

At 2:40 pm. LPAs observed that licensee does have current Mandated Reporter AB 1207 compliant Child Care Training Certificate on file. Due to language barrier, S1 and S2 does not have mandated reporter on file. Page 3 of 6

LPAs issued a copy of the LIC 857 Children’s Records Review and the LIC859 Staff Records Review to the licensee during this inspection.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPAs also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

MyChildCarePlan.org – Centers and Family Child Care Homes Licensee [or facility representative] was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Megan’s Law - Family Child Care Homes During the exit interview, the Licensee Tzu Man Yu, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
