Licensing Program Analyst (LPA) Fabiola Vasquez conducted an unannounced continuation inspection at the above facility on 9/26/22 at 8:40 AM. LPA met with Socorro Tamayo, Licensee who guided LPA on a tour of the facility. During the tour LPA observed in one of the bedrooms accessible to children in care a baby carrier seat on top of the bed, covered with a blanket, licensee removed the blanket, LPA observed an infant inside the baby carrier. Per licensee her assistant, daughter was supervising the infant, LPA observed that the infant was alone in the bedroom with the door closed. LPA observed the infant to be asleep and strapped in, LPA instructed the licensee to remove the infant from the baby carrier, licensee was informed that baby carriers are strictly used for transportation purposes. Per licensee, the infant had not been in the baby carrier long, she had told her daughter to take the infant out and she did not do it. LPA asked what time the infant arrived, per licensee the infant arrived at 6:00 AM. Shortly after the daughter came out from the restroom.

LPA continued with the tour LPA observed in another room a baby walker, licensee removed the walker during the inspection. Present during the tour were Licensee, 2 adult daughters with 4 children, 1 being an infant. LPA observed 2 small size dogs in the back yard.

On the initial inspection on 6/24/22 licensee guided analyst on a tour of the facility at approximately 9:20 AM. Facility capacity is in compliance for a Small Family Child Care Home. Present were one infant, licensee and her two adult daughters. Per licensee she has a foster licensee.

This is a one-story home which consists of four bedrooms, two bathrooms, kitchen, dining room, living room, front and back yard (fenced), detached garage, bathroom in the garage. LPA observed the detached garage is converted into a room with a kitchen counter, a build in sink, microwave, television, and a couch. LPA observed the garage has an extended room converted into a playroom with tables and chairs for the daycare children. Per licensee the garage and the extended room are not being used for sleeping or eating.

LPA obtained a declaration. LPA observed an individual room located towards the back of the yard, LPA observed a crib inside the room, per licensee she does not use the crib for the day care children, the crib is stored there only. Per licensee, the crib was her grandchildren’s licensee stated that she will take it apart and store in the shed. Per licensee, the room is occupied by one of her adult daughters. LPA observed a storage shed the back yard.

Per licensee areas accessible to children are main house; 3 bedrooms, bathroom located in the hallway, living room, dining room, back yard, detached garage (declaration in file), bathroom in the garage.

Per Licensee, areas off limits to children and parents include the individual room located in the back yard, storage shed. Hours of operation are Mon-Sat 6:00 AM - 7:00 PM. Food is provided by Licensee.

LPA observed the following required posted documentation in the main entry way of the facility: Facility License, Publication (PUB) 394- Notification of Parent Rights and Licensing Form (LIC) 9148- Earthquake Preparedness form. LPA reviewed facility records for LIC 9040- Facility Roster, LIC 610- Facility Disaster Plan and Missing proof of disaster drill log.

Smoke and carbon monoxide detectors were tested and are operable. Fire extinguisher indicated fully charged date services 9/2/22. The home maintains telephone service via cell phone. The home is observed to be clean and orderly. There are toys and other age appropriate material available for children.

Per licensee, the home has central AC and heater. LPA observed that detergents, cleaning compounds are in the laundry room, LPA observed the medication to be stored in the kitchen in a high cabinet inaccessible to children. Licensee states that there are no poisons stored in the home and understands that all poisons must be lock, not only inaccessible to children. Isolation area for sick children waiting to be picked up is in one of the main care bedrooms, away from the other children. Per Licensee there are no firearms or weapons stored in the home.

Infant Care: Currently licensee cares for one infant. LPA observed a play yard in one of the bedrooms. Napping equipment does not block entrances or exits. Infant mattresses were observed to be firm with tightly fitted sheets. LPA did not observe loose objects, bumpers, objects hanging, or objects attached to the cribs. Per licensee wet or soiled sheets are put in a basket and washed by licensee. Each infant has their own crib and bedding. Bedding changed daily. LPA discussed with licensee of the new Safe sleep regulations, including LIC 9227 Infant Sleep Plan for infants under 12 months, 15-minute sleep check documentation for infants 0-24 months. Per licensee, the Licensee states the following as a sleep supervision plan for infants: We sit in the main care area and supervise the children. There are two of us so we can always check the children.

Children are using the back yard for outdoor play. The outdoor play area was observed to be fenced. LPA observed that the outdoor yard has toys and other materials for children to play with. Children’s records were reviewed for (LIC) 282- Affidavit Regarding Liability Insurance, Immunization's Records, LIC 700- Identification and Emergency Information, LIC 627- Consent for Medical Treatment, LIC 995A Notification of Parents’ Rights, LIC 9227- Infant sleep form (0-12 months, and documentation of 15-minute Infant Sleep Check (0-24 months). LIC 995A Notification of Parents’ Rights.



Staff records were reviewed for approved Pediatric First Aid and CPR certification, dated: 1/15/24 LIC-501: Personnel Record, LIC 508- Criminal Record Statement, LIC 9052- Employee Rights, Proof of immunizations against measles, pertussis and influenza or influenza declination, TB clearance or risk assessment, LIC 9108- Statement Acknowledging Requirement to Report Child Abuse and current Mandated Reporter Training Certificate. Staff (S): L, S2 missing proof of MMR, T-DAP. Staff 2 is missing proof of TB. Licensee, Staff 1 and 2 are missing proof of Mandated Reporter Training Certificate.

During inspection all children were observed to be treated with dignity and respect, they were observed to be receiving safe, healthful and comfortable accommodations, furnishings and equipment, and free from corporal and/or unusual punishment.

Incidental Medical Services (IMS):
Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a plan for providing IMS must be submitted to the Department. LPA Vasquez informed licensee Socorro Tamayo, that this report dated 09/26/22 document 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Vasquez informed the licensee Socorro Tamayo, to provide a copy of this licensing report dated 09/26/22 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee Socorro Tamayo,
