At 1:10 PM Licensing Program Analyst (LPA) Roxana Lopez conducted an unannounced annual required inspection to the above facility. This facility is approved to provide child care services to military families- no military families enrolled. LPA met with Diana Perez Assistant, who guided analysts on a tour of the facility. Also present during inspection was Assistant Tania Perez. Per assistant, Licensee was not home. Per Assistant, there are 20 children that are currently enrolled. A current children’s roster was available for review. There were 16 children present upon arrival- 1 being an infant. The facility was observed to not be operating within the license capacity limitations. LPA advised that facility is licensed for 8 children and this is an immediate risk for children in care.

At 1.22 pm LPA entered a closed bedroom used as a nap room and observed Infant Child # 1 sleeping on a rocker chair covered with a blanket and a bottle next to them. LPA advised this was an immediate risk- child was transition on a cot during inspection.

Licensee arrived at 1: 50 pm and took over the inspection.

Per Licensee, they currently has 2 assistants. All adults present in the home have obtained a criminal record clearance or exemption prior to working, residing or volunteering in the licensed child care home. Licensee states that there are no weapons stored in the home.

This is a one story home which consists of 3 bedrooms, 2 bathrooms living room, kitchen, garage and backyard (fenced). The children have access to living room, 2 bedrooms, 1 bathroom and backyard fenced.

The LPA toured all areas used by children during this visit. All areas identified on the facility sketch that are accessible for children to use were inspected for safety, comfort, and cleanliness.------------ pg. 1 of 4 ---

There is telephone service via a cellphone that stays at the facility during operation hours. There is ventilation and heating (central). The following was observed and reviewed during this inspection.

Detergents, cleaning compounds, and medications were observed to be inaccessible to children. Per Licensee, there is no poisons in the home. The restroom that children use was observed to be safe and sanitary.

The valve on the required 2A 10BC fire extinguisher indicates fully charged and was serviced on 8/3/2023, as indicated on service tag. Smoke and carbon monoxide detectors were tested and are operable. All homes shall conduct fire and disaster drills at least once every six months, and document the date and time of each drill.

At 1:30 pm LPA observed that last drill documented was conducted on 10/19/2023.

Emergency Disaster Plan, Parent’s Rights Poster and the Facility License were observed to be posted in the entrance of the home.

The home is observed to be clean and orderly. There are toys available for children. Sleeping arrangements in forms of cots were observed- LPA advised that infants should sleep in a crib or playpen only- once child is able to climb out they can place them in a cot.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
At 2:30 pm LPA observed that infant child # 1 did not have the LIC 9227 Individual Sleeping Plan form on file and sleeping log documenting supervision every 15 minutes was not available for review.

Smoking is prohibited in a licensed Family Child Care Home. Per Licensee, no one smokes in the home.

Currently, children are using the back yard for outdoor play time. The outdoor play area was observed to be fenced. LPA observed children playing outside on a waterslide- LPA advised that adult had to supervising water slide at all times. LPA observed that the outdoor yard has toys and other materials for children to play with. LPA did not observe any objects that can pose a danger to children on the outdoor yard.

Per licensee they have a small dog in the facility.

By 3:04 pm Licensee was in compliance with 8 children.

The licensee and other personnel have completed training on preventive health practices including Pediatric First Aid and CPR. The licensee's and assistants Pediatric First Aid and CPR expires on 8/11/2025. There are first aid supplies available. LPA observed that the Licensee and assistant do have proof of immunization record.

At 3:30 pm LPA observed that both assistants did not have a current Mandated Reporter AB 1207 compliant Child Care Training Certificate on file.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

During the exit interview, the Licensee Carina Perez, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Based on the LPA’s observations and records review, the following deficiencies listed on the attached LIC 809D (deficiency page) are being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health & safety.

LPA Roxana Lopez informed licensee Carina Perez that this report dated 7/23/2024 document(s) 2 Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Roxana Lopez informed the licensee to provide a copy of this licensing report dated 7/23/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
