32 | During the inspection LPA Lee explained to the Director that while the facility reasoning for requesting this condition in their handbook was understandable, it is still technically a violation of parents rights. LPA Lee pointed out the parents rights poster that was near the entrance of the facility which stated that parents of children in care have the right to inspect the facility during business hours.
During the inspection, LPA Lee advised the facility to modify this section of their supplemental handbook so that Parents rights of children in care are not violated by any of the conditions. While the condition does not have to completely eliminated, LPA Lee advised that it would need to be modified so that it takes into account existing regulations regarding rights of parents.
Based on the information obtained during the investigation, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations,(Title 22, Division 12 & Chapter Number 6), are being cited on the attached 9099D.
The notice of site inspection must remain posted for a period of 30 days during hours of operation. Failure to maintain posting will result in a civil penalty of $100.00 dollars.
