Licensing Program Analyst (LPA) Mireya GarcĂ­a arrived unannounced at the facility for the purpose of conducting a follow up complaint investigation to deliver findings regarding the allegations listed above. Due to COVID- 19 precautionary measures were taken, licensing staff present during inspection wore appropriate personal protective equipment. LPA Garcia met with Licensee, Sandra Hernandez who guided LPA on a tour of the facility. There were five (5) children observed to be present at the facility during this inspection, two (2) being infants.
Information provided by the complainant alleges that daycare home smells of marijuana and licensee yells at daycare children.

During this investigation LPA Razo interviewed Licensee, two (2) day care staff, one (1) day care child, one (1) adult family member and additional interviews were held over the phone with five (5) parents.

Pertaining to the allegation that daycare home smells of marijuana; During the facility tour on 8/31/2022, LPA Razo did not detect marijuana odor nor a cigarette smoke. LPA Razo did not observe cigarette ashes as well. There were no disclosures that the facility has marijuana smells. There were no statements to indicate that there were smokers in the facility. Parents interviewed are happy with care provided by the staff and have no concerns.

Regarding to the allegation that licensee yells at daycare children, investigation has revealed that there were no disclosures to indicate that Licensee or anyone yells at daycare children. Majority of the children present were either too young to respond or refused to be interviewed. Parents interviewed disclosed being happy with care provided by the staff and have no concerns.

Based on the interviews conducted and records review, at this time there is not enough evidence to support the above allegations.

This agency has investigated the complaint alleging that daycare home smells of marijuana and licensee yells at daycare children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore at this time the above allegations are deemed unsubstantiated. Should additional information become available in the future, this investigation may be reopened.



A notice of site visit was given and must remain posted for 30 days.
