25 | Licensing Program Analyst (LPA) Nolan Tcheng conducted an unannounced Case Management inspection to follow up on an incident report submitted to the department on 01/30/2023. Upon arrival at 9:15am, LPA was greeted by Director Kobi Gonzalez, to whom the purpose of the inspection was explained. At 9:25am, LPA was provided a tour of the facility where there were children present during the time of inspection. Census was taken. There were 40 children and 7 staff members.
On 01/27/2023, during transition time, a child was putting their stuff away during drop off. Staff #2 was transitioning the children in the classroom outside for outdoor play time. During that time, child was left in the classroom unsupervised. Staff #3 was entering the classroom and observed the child by them self. Staff #3 brought child back to Staff #2's group. Per Staff #2, child had just been dropped off and they had not recounted before moving on from the classroom. During the inspection, LPA conducted interviews with 2 staff members and obtained documentation in the form of Supervision Agenda Training and acknowledgments.
Based on interview and record review, the facility was in violation of California Title 22 Code of regulations for "Responsibility for Providing Care and Supervision." The deficiency listed on the following pages were observed by the LPA and are being cited in accordance with California Code of Regulations Title 22. Please see attached LIC 809D for deficiencies that are being cited and need to be cleared to protect the children’s health & safety.
Upon receipt of this report, the Licensee shall post the Notice of Site visit and any licensing report documenting a type “A” deficiency. The report and the Notice of Site visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty. A copy of this report shall be provided to the parent/guardian of children currently enrolled by the next business day or immediately upon return. A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). The Acknowledgement form must be maintained in each child’s file immediately upon receipt from parent. Licensee was provided with a copy of the parent Acknowledgement of Receipt of Licensing Reports Form during this visit. A copy of the Parent Notification Requirements was also provided to the licensee. REPORT CONTINUES PAGE 1 of 2
