Licensing Program Analyst (LPA) Lilli Babcock conducted an unannounced Case Management inspection due to an incident that occurred on 3/5/25 and was reported to the Department. A COVID risk assessment was conducted. LPA met with Director, Maribeth Peralta to whom the reason for the visit was explained. Director guided LPA on a tour of the facility. Census was taken. There were 8 staff present caring for 83 children. The facility was observed to be operating within the license capacity limitations.

An unusual incident report was made to the Department regarding an incident on 3/5/25 that involved Child #1 (C1) biting Child #2 (C2) through the pants of C2 on the upper right thigh causing a break in the skin and bleeding of C2. The incident occurred in the classroom. LPA conducted interviews with three staff who were in the room at the time of the incident as well as the Director. All staff interviewed disclosed that Child #1 had bitten Child #2 previously. Director stated C1 had bitten C2 three times prior to the incident on 3/5/25. During interviews it was disclosed that C1 "targeted" C2, and the plan to ensure C1 was not able to bite C2 was to keep C1 and C2 separated at all times. During interviews, Staff stated there was no specific plan for which staff would supervise C1 or C2 at the time of the incident and that no staff observed the incident occur and staff only knew C2 had been bit when C2 began crying. Director stated, "They (staff) were not looking and that is why C1 got the chance to get on top of (C2). They did not see them together cuz they were not looking at them."

During the visit, LPA obtained a copy of the facility biting policy, a picture of the injury to C2, and facility incident reports for both C1 and C2.

Based on interviews, the licensee did not comply with the section cited above as a child bit another child without any staff visually supervising which poses/posed an immediate health, safety or personal rights risk to persons in care.

Based on LPA interviews with staff, the following deficiency listed on the attached LIC 809D (deficiency page) is being cited in accordance with California Code of Regulations Title 22. Deficiencies that are being cited need to be cleared to protect the children’s health and safety.

LPA Babcock informed facility representative, Maribeth Peralta that this report dated 3/20/25 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Lilli Babcock informed the facility representative to provide a copy of this licensing report dated 3/20/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
