32 | The allegation was found unsubstantiated based on the following observations and interviews. LPA Calderon toured and observed the alleged unlicensed home; there were no signs of a day care setting, although LPA did observe a few items intended for children; Licensee Clark informed LPA these items are used for her grandchildren when they are not receiving daycare services.
Based on previous investigations conducted with neighboring residents who surround the alleged unlicensed home, 3 interviewed neighbors informed LPA Calderon have not seen day care children at the alleged unlicensed home. Based on interviews with children 3 out of 4 children, although they mentioned Licensee Clark having an additional home and going to another home there were discrepancies in the children’s interviews. Per Licensee Clark’s interview, they informed LPA they do provide transportation services and at times picks up grandchildren from their whom who also receive day care services and sometimes has other day care children with them although care is not provided at this location.
3 out of 3 staff interviewed informed LPA Calderon children are being provided transportation services and Licensee transports the children to above day care address or places for field trips to places intended for children and staff did not mention children get taken to unlicensed home. 3 out of 3 parent interviews were conducted and informed LPA facility provides transportation services, and they had signed written consent authorizing transportation. 2 out of 3 parents interviewed did not report children being transported to an unlicensed care location and transportation services are utilized for field trips and/or school pickups for school age children. 1 out of 3 parents interviewed informed LPA Calderon the children get transported to an unlicensed home by the Licensee and staff assistants stay there with the children
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore, the allegation is unsubstantiated.
No deficiencies are being cited according to California Code of Regulations, Title 22.
